Regarding this issue, LawNet would like to answer as follows:
On November 29, 2023, the Ministry of Natural Resources and Environment issued Decision 3610/QD-BTNMT on Regulations on Organization and Operation of the Organization of ASEAN Senior Officials on Environment in Vietnam.
Specifically, in Article 3 of the Regulations issued with Decision 3610/QD-BTNMT in 2023, ASOEN Vietnam members include the President of ASOEN Vietnam, Working Groups under ASOEN Vietnam, and the ASOEN Vietnam Office.
(1) The Chairman of ASOEN Vietnam is the Deputy Minister of Natural Resources and Environment, appointed by the Minister of Natural Resources and Environment. Working on a part-time basis, he has the task of helping the Minister of Natural Resources and Environment direct and coordinate the activities of ASOEN Vietnam.
(2) Working groups under ASOEN Vietnam were decided to consolidate by the Minister of Natural Resources and Environment in Decision 1739/QD-BTNMT in 2023, including:
- ASOEN Vietnam working group on biodiversity conservation.
- ASOEN Vietnam working group on water resources management.
- ASOEN Vietnam working group on environmentally sustainable cities.
- ASOEN Vietnam working group on environmental education.
- ASOEN Vietnam working group on marine and coastal environment.
- ASOEN Vietnam working group on climate change.
- ASOEN Vietnam working group on chemicals and waste.
- National focal point for ASEAN-China cooperation on the environment.
- Focal point of the ASEAN Biodiversity Center.
- Coordination focal point for the Committee to implement the ASEAN Agreement on Transboundary Haze Pollution (AATHP).
Team leader, deputy team leader, and focal unit Working group under ASOEN Vietnam is decided by the Chairman of ASOEN Vietnam to assign personnel based on Decision 1739/QD-BTNMT in 2023 of the Minister of Natural Resources and Environment.
The team leader and deputy team leader work on a part-time basis, taking personal responsibility for the tasks assigned by the President of ASOEN Vietnam. The working term of the Working Group Head under ASOEN Vietnam is 3 years; he was reappointed for the next term following the decision of the President of ASOEN Vietnam.
(3) ASOEN Vietnam Office was established by the decision of the Minister of Natural Resources and Environment, located at the Department of International Cooperation, Ministry of Natural Resources and Environment, has the function of helping the President of ASEAN Vietnam direct, coordinate, and organize the implementation of ASEAN cooperation tasks in the field of environment under the authority of the President of ASOEN Vietnam and link and support the activities of groups under ASOEN Vietnam.
ASOEN Vietnam Office includes the Chief of Office, Deputy Chief of Office, and civil servants and officials appointed and decided by the President of ASOEN Vietnam.
ASOEN Vietnam has the following tasks:
(1) Advise and assist the Minister of Natural Resources and Environment in implementing Vietnam's obligations within the ASOEN framework.
(2) Participate in activities within the framework of ASOEN; preside over coordinating and organizing the implementation of obligations that Vietnam must implement within the framework of ASEAN cooperation on the environment; and chair the organization of conferences, seminars, and events in Vietnam within the framework of ASOEN.
(3) Summarize the activities of ASOEN and ASOEN Vietnam to report to the Minister of Natural Resources and Environment, the National Secretariat for ASEAN, and other relevant authorities; Propose and submit to the Minister of Natural Resources and Environment a plan for environmental cooperation between Vietnam and ASEAN member countries, dialogue countries, and international organizations; the annual and long-term plans of ASOEN Vietnam, implemented upon approval.
(4) Closely coordinate with the focal point for activities of the ASEAN Socio-Cultural Community in the process of coordinating and implementing activities related to ASEAN-Vietnam cooperation on the environment.
(5) Perform other tasks as assigned by the Minister of Natural Resources and Environment and the National Secretariat for ASEAN.
(Article 5 of the Regulations promulgated together with Decision 3610/QD-BTNMT 2023)
Decision 3610/QD-BTNMT takes effect from the date of signing and replaces Decision 1456/QD-TCMT in 2015 of the General Director of the General Department of Environment.
