On December 27, 2024, the Government of Vietnam issued Decree 170/2024/ND-CP providing guidance on the organization of urban administration in Da Nang.

Regulations on the number of commune-level officials in Da Nang from January 1, 2025

Article 13 of Decree 170/2024/ND-CP regulates the number of commune-level officials in Da Nang from January 1, 2025, as follows:

- Officials working at wards and communes are under the staff of district-level officials in the city; managed and utilized by the District People's Committees.

- The number of officials working at wards and communes is determined according to the regulations of the Government of Vietnam on the number of commune-level officials.

- Decision and allocation of the number of officials working at wards and communes:

(i) Annually, the City People's Committee submits to the City People's Council for decision-making the number of officials working at wards and communes for each district under the total number of officials assigned to the District People's Committees, ensuring that the total number at wards and communes in districts does not exceed the total number of officials calculated for the entire city according to legal regulations;

(ii) Based on the number of officials working at wards and communes for each district as decided by the City People's Council per regulation (i), the District People's Committees decide the specific number of officials working at each ward and commune and allocate officials for each role at wards and communes within their management scope to suit the needs and duties of each ward and commune.

The number of officials at each ward and commune may be lower than level III wards and communes or higher than level I wards and communes according to legal provisions but must not exceed the total number of officials working at wards and communes for the entire district as assigned by the City People's Council.

Regulations on election, use, and management of commune-level officials in Da Nang

According to Article 14 of Decree 170/2024/ND-CP, the election, use, management, dismissal, and resignation of officials working at wards and communes in the city comply with the provisions of the Law on Officials, Law on Organization of Local Government, Law on Election of Deputies to the National Assembly and to the People’s Council, and other relevant legal provisions, rules of the Communist Party, and central socio-political organizations.

After the competent authority approves the election results or appoints official positions at wards and communes, the Chairman of the City People's Committee, based on professional standards and official ranks, issues a decision to appoint the official to an official rank and determine their salary within the commune-level official category.

This decision serves as the recruitment decision for officials not yet in the official rank, for the purpose of arranging and assigning work accordingly.

The leadership position allowance for officials working at wards and communes in the city is implemented according to the regulations of the Government of Vietnam on managing commune-level officials.

According to the requirements, work tasks, or upon vacating positions, officials working at wards and communes may be arranged, assigned tasks, mobilized, or transferred to work at wards and communes or move to district-level officials or higher if they meet the new job position's standards and conditions. Appointment to official ranks and salary allocation at the new position is conducted following the legal management of officials.
