Regulations on the Judges Committee of the Military Region Military Courts and Equivalent

Ordinance on the Organization of Military Courts of 2002The Ordinance on the Organization of Military Courts of 2002 was issued on November 4, 2002. This Ordinance stipulates the organizational structure, jurisdiction, as well as the duties and powers of the military courts. Notably, it includes provisions regarding the Judicial Committee of the Military Region Court and equivalent courts.

To be specific, according to the provisions of Article 27 of the Ordinance on Organization of Military Courts 2002, the Judge Committee of the Military Regional Court and equivalent consists of:

- Chief Judge, Deputy Chief Judges of the Military Regional Court and equivalents;- Some Judges of the Military Regional Court and equivalents decided by the Chief Judge of the Central Military Court based on the proposal of the Chief Judge of the Military Regional Court and equivalents.

The total number of members of the Judge Committee of the Military Regional Court and equivalents shall not exceed five persons.

The Judge Committee of the Military Regional Court and equivalents has the following tasks and powers:

- Reviewing cassation and reopening proceedings of criminal cases whose legally effective judgments and decisions of lower Military Courts are protested in accordance with procedural law;- Ensuring the uniform application of law in their Military Court and lower Military Courts;- Summarizing trial experiences;- Approving reports of the Chief Judge of the Military Regional Court and equivalents on the work of Military Courts within their military region and reporting to the Chief Judge of the Central Military Court, the Commander of the military region and equivalents.

Meetings of the Judge Committee of the Military Regional Court and equivalents must have at least two-thirds of the total number of members attending. Decisions of the Judge Committee of the Military Regional Court and equivalents must be approved by more than half of the total number of members voting in favor.
