Regulations on the Issuance of Fishing Vessel Registration Certificates

The Fisheries Law 2017 stipulates that fishing vessels with a maximum length of 06 meters or more must be registered in the national fishing vessel registry and issued a Certificate of Fishing Vessel Registration as prescribed. Fishing vessels with a maximum length of less than 06 meters shall be recorded by the commune-level People's Committee for management purposes.

Provincial People's Committee grants fishing vessel registration in the locality.

  1. Conditions for Issuance

A fishing vessel is issued a Fishing Vessel Registration Certificate when the following conditions are met:

- There are documents proving the lawful ownership of the fishing vessel;- There is a Technical Safety Certificate for the fishing vessel for those vessels required to undergo registration;- There is a certificate of temporary cessation of registration for chartered bareboat vessels; a certificate of deregistration for imported, bought, donated, or transferred fishing vessels;- The fishing vessel owner has a headquarters or permanent residence registered in Vietnam.

  1. Validity

The validity period of the Fishing Vessel Registration Certificate is stipulated as follows:

- The Fishing Vessel Registration Certificate is issued with no time limit for newly built, converted, imported, bought, donated, or aided vessels;- The Fishing Vessel Registration Certificate is issued for a term equal to the charter period for bareboat chartered vessels.

  1. Deregistration of Fishing Vessel

A fishing vessel is deregistered in one of the following cases:

- The vessel is destroyed, broken up, or sunk and cannot be salvaged;- The vessel is missing for one year since the official announcement in public media;- The vessel is exported, sold, donated, or aided;- Upon the request of the fishing vessel owner.

When deregistering, the competent registration authority shall reclaim the Fishing Vessel Registration Certificate, remove the vessel name from the national fishing vessel registration book, and issue a Deregistration Certificate to the vessel owner.

Fishing vessel refers to a watercraft, with or without an engine, including fishing vessels that exploit aquatic resources and auxiliary fishing vessels exploiting aquatic resources. (Clause 20 Article 3 Fisheries Law 2017).
