Regarding this matter, LawNet would like to answer as follows: 

On May 2, 2024, the People's Committee of HCMC, Vietnam, issued Decision 20/2024/QD-UBND on regulations for evaluating and grading the quality based on the job performance of officials, public employees, and employees at agencies and units in HCMC, Vietnam.

Regulations on the grading of quality for officials and public employees in HCMC, Vietnam

The grading of quality for officials and public employees in HCMC, Vietnam is as follows:

- Calculation of scores and determination of the official total score:

+ The score for each evaluation criterion for the head of central agencies in HCMC, Vietnam, is determined by the average score of each criterion that members of the leadership collective of that agency have scored.

+ The official total score is equal to the total score achieved in all criteria stated in Article 7 and Article 8, minus any additional deducted points (due to multiple violations, deducted points beyond the criteria) of the criteria group on organizational discipline awareness and ethical qualities stated in Clause 1 of Article 7 and Clause 1 of Article 8, as regulated in Decision 20/2024/QD-UBND.

- Grading of quality:

+ Levels of quality classification and minimum scores to be achieved:

Excellent completion of tasks

Official total score from 90 to 100 points

Good completion of tasks

Official total score from 75 to below 90 points

Completion of tasks

Official total score from 50 to below 75 points

Failure to complete tasks

Official total score below 50 points

+ For the directors of departments, central authorities of the city, district-level People's Committee Chairpersons, and commune-level People's Committee Chairpersons, their grade must be linked to the responsibility of ensuring the satisfaction rate of citizens and businesses regarding administrative procedures at the agency or unit they are in charge of. To be specific:

Achieving a score of 90 or above and a satisfaction rate of citizens and businesses of 90% or above is required to be graded as Excellent completion of tasks.

Achieving a score from 75 to below 90 and a satisfaction rate of citizens and businesses of 80% or above is required to be graded as Good completion of tasks.

- Officials and public employees, employees who are disciplined, prosecuted, detained, or held pending conclusions by competent authorities in a quarter will be assessed and graded as Failure to complete tasks. In case the party disciplinary decision and administrative disciplinary decision regarding the same violation are issued in different quarters, only the grade of Failure to complete tasks will be applied to the quarter being disciplined.

- If officials and public employees, employees who are disciplined by competent authorities receive written criticism regarding their performance of duties and tasks, they will not be evaluated and graded as Excellent completion of tasks.

Dossiers on evaluation and grading of quality for officials and public employees in HCMC, Vietnam

- Dossiers on evaluation and grading of quality are kept at the agencies and units, including:

+ Self-evaluation forms, rating sheets for each individual.

+ List of overall evaluation results and grading of quality for officials and public employees, and employees.

- Dossier on evaluation and grading of quality are made and stored electronically. In cases where the agency or unit has not yet met the conditions for making and storing electronically, they may be stored in paper form.
