Regulations on the Evaluation of Officials and Public Employees

In the management of officials and public employees (Vietnamese official and public employee), the evaluation and classification of Vietnamese officials and public employees is one of the important activities. It plays a decisive role in the development process of the personnel team, the efficiency in completing the assigned tasks of the Vietnamese official and public employee, and the stability and strength of the agencies, organizations, and associations.

Decree 56/2015/ND-CP stipulates quite specifically the principles for evaluating and categorizing Vietnamese official and public employees as follows:

- Based on the responsibilities assigned and the results of task execution, as well as the strengths, weaknesses, existing limitations, and capacity, qualifications of Vietnamese official and public employees, appropriate evaluation opinions should be made.- The evaluation process must avoid being merely formal and must ensure objectivity, fairness, accuracy, and impartiality, without favoritism or persecution towards any Vietnamese official and public employee.- The evaluation and categorization must be conducted appropriately within the authority: officials are evaluated by the authorized managing level; public employees are evaluated by the heads of agencies, organizations, or units. The level and persons performing the evaluation are simultaneously responsible for the categorization and must be accountable for their decisions.- For those Vietnamese official and public employees who fail to accomplish tasks due to objective factors or force majeure, such considerations can be taken into account during the evaluation and categorization to ensure fairness and benefits for the employees in question.- It should be noted that the task completion level of the head should not be higher than the task completion level of the Department, unit (including divisional level).

Vietnamese official and public employees are evaluated based on the following grounds:

- For officials:- Obligations, ethics, communication culture, and prohibited activities specified in the Law on Officials and Public Employees;- Criteria of positions and titles of officials;- Annual work program and plan of the agency, organization, or unit under their direct management authority or assigned or approved by the competent authority.- For public employees:- Obligations, ethics, communication culture, and prohibited activities specified in the Law on Officials and Public Employees and guided by Guidance 1326/HD-UBDT 2015 issued by the Committee for Ethnic Affairs.- Standards of rank for public employees, leadership, and management positions;- Tasks according to the annual work program and plan assigned or directed for implementation.- For public employees under the Law on Public Employees:- Commitments in the signed work contracts;- Professional ethics regulations, code of conduct for public employees.

Annually, the provinces and cities always issue directives and plans to guide all administrative units, departments, sectors, and district-level People's Committees to evaluate and categorize Vietnamese official and public employees associated with enhancing the responsibilities of heads of agencies and units in evaluating Vietnamese official and public employees. Based on the evaluation content, the classification levels include excellent task completion; good task completion; task completion; and task non-completion. Through this, arrangements, usage, training, fostering, rank promotion, professional title upgrading, planning, appointment, dismissal, transfer, rotation, commendation, discipline, and implementation of other policies for Vietnamese official and public employees can be executed.
