Regulations on the criteria for emulation in inmate's performance grade in Vietnam

According to Article 19 of Decree 118/2024/ND-CP, which stipulates the standards for performance grade compliance with prison sentences, the assessment, evaluation, and determination of the inmate's performance grade are based on the following criteria:

(1) Clear acknowledgment of guilt, remorse; honest confession, reporting of crimes known; actively mitigating consequences caused by one's criminal acts.

(2) Strict adherence to legal regulations, court judgments, decisions, and prison regulations; actively preventing and combatting violations; practicing discipline, order, civility; not exhibiting any negative attitude, speech, or actions that cause division, loss of solidarity, and adversely affect others.

(3) Active, voluntary, exemplary participation in labor, vocational training, full attendance on workdays, disciplined work with productivity and quality, fulfilling labor targets and quotas; good implementation of safety, labor hygiene, and environmental protection; with a sense of promoting the competition movement among prisoners.

(4) Active, voluntary learning, training, moral self-improvement; respecting the life, health, honor, dignity, and property of oneself and others; showing a willingness to help other prisoners in their training, learning progress, and striving to become beneficial to society.

Regulations on performance grade for those who have made merits in Vietnam

Article 24 of Decree 118/2024/ND-CP provides guidelines on performance grade for those who have made merits in Vietnam as follows:

(1) A prisoner categorized under any of the following meritorious conduct cases will have their performance grade upgraded by one level for four consecutive quarters from the date the head of the prison facility signs the commendation decision, or from the date of receiving a commendation decision from a competent state authority for the meritorious act, including:

- Rescuing a person in a life-threatening situation or State, collective, or citizen assets valued at 50,000,000 VND (fifty million Vietnamese Dong) or more during natural disasters, fires, or accidents;

- Assisting the prison facility in preventing other prisoners from escaping or committing new crimes;

- Helping competent state authorities to detect, investigate, capture, and prosecute criminals; having discoveries, inventions, significant innovations, or other exceptionally outstanding achievements recognized by the prison facility or competent state authorities.

If during those four quarters the prisoner was rated well, it will be counted for the next four quarters. If after the meritorious act, the prisoner is disciplined or commits a new crime, the performance grade level will not be raised.

(2) If a meritorious act is committed during the period after a decision to execute a prison sentence has been made but the prisoner has not yet been transferred to the facility to serve the sentence, it is still considered a meritorious act during the prison sentence and will be reviewed and rated as in case (1) above.

More details can be found in Decree 118/2024/ND-CP, which comes into force in Vietnam from November 15, 2024.
