Regulations on the Approval Process of Procurement Plans under the CPTPP Agreement

Recently, the Government of Vietnam has issued Decree 95/2020/ND-CP providing guidelines for the implementation of procurement bidding under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Decree 95/2020/ND-CP specifies the approval process for contractor selection plans for procurement under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, specifically:

1. Responsibility for submitting the contractor selection plan:

- The investor for the project, and the bid solicitor for regular procurement, are responsible for submitting the contractor selection plan to the authorized person for review and approval;- For the bidding package that needs to be implemented before the project is approved, if the investor is identified, the unit under the investor's authority is responsible for submitting the contractor selection plan to the head of the investor for review and approval. If the investor has not been identified, the unit assigned to prepare the project is responsible for submitting the contractor selection plan to the head of their unit for review and approval.

2. The submission document for the contractor selection plan includes the following contents:

- Completed tasks, including tasks related to project preparation, previously implemented packages with corresponding costs, and the legal basis for their execution;- Tasks not subject to any contractor selection methods, including: project management board operations, resettlement compensation organization, groundbreaking ceremonies, inaugurations, interest payment, and other tasks not subject to contractor selection methods;- Tasks included in the contractor selection plan, including task details and corresponding values forming the bidding packages to be executed by one of the selection methods stipulated in this Decree. This section must clearly state the basis for dividing the project and procurement estimate into bidding packages. For each package, it must ensure there are sufficient details as stipulated in Article 29. For packages applying the direct appointment method, the submission document must clearly state the reasons;- Tasks not yet qualified for a contractor selection plan, if any, must specify the content and value of these tasks;- The overall value of the tasks specified in the above points. The total value of this section must not exceed the approved project investment or procurement estimate.

3. Documents attached to the submission for the contractor selection plan:

Upon submitting the contractor selection plan, a photocopy of the documents forming the basis for the plan preparation as prescribed in Article 28 of this Decree must be attached.
