Regarding this issue, LawNet would like to answer as follows:

On October 16, 2023, the Minister of Natural Resources and Environment issued Circular 13/2023/TT-BTNMT, providing technical regulations on monitoring and providing information and hydrometeorological monitoring data for specialized hydrometeorological stations.

Regulations on specialized hydro-meteorological monitoring content as of December 1, 2023 in Vietnam

Specifically, Article 4 of Circular 13/2023/TT-BTNMT regulates the content of specialized hydro-meteorological monitoring from December 1, 2023, as follows:

(1) The minimum content of hydro-meteorological monitoring for each type of project requiring specific hydro-meteorological monitoring is as follows:

(i) Civil airport monitoring according to regulations of the Ministry of Transport;

(ii) Dams and reservoirs of special importance, large and medium types, are monitored according to the Government's regulations on safety management of dams and reservoirs; dams and reservoirs are within the scope of regulation of the inter-reservoir monitoring operation process according to the regulations of the inter-reservoir operation process;

(iii) The port monitors wind direction and speed, sea level, waves, seaward visibility, and frequency 04 times/day at 01:00, 07:00, 13:00 and 19:00;

(iv) Bridges with a navigable aperture of 500 meters or more monitor wind direction and speed with a frequency of 04 times/day at 01:00, 07:00, 13:00, and 19:00;

(v) The radio and television broadcasting tower combines sightseeing and business operations to serve customers on the tower to monitor wind direction and speed, with a frequency of 03 times/day at 7:00 a.m., 1:00 p.m. and 7:00 p.m.;

(vi) Cable cars serving sightseeing and tourism activities monitor wind direction and speed and hourly frequency during operation;

(vii) The National Park monitors rainfall, temperature, air humidity, wind direction, and speed, 4 times/day at 01:00, 07:00, 13:00 and 19:00;

(viii) Expressway routes are monitored according to national technical standards on traffic monitoring and control systems on highways;

(ix) General inland waterway ports of type I or higher monitor visibility, water level, wind direction, and speed, frequency 04 times/day at 01:00, 07:00, 13:00 and 19:00;

(x) Projects of a specific nature include islands in the Truong Sa archipelago, rigs belonging to economic and technical service clusters (DK1), and military airports serving national defense and security monitoring purposes according to regulations of the Ministry of National Defense.

(2) When there are forecasts and warnings of dangerous hydrometeorological phenomena from the National Hydrometeorological Forecast and Warning System and forecast the possibility of a direct impact on the province or city where the project is located. Depending on the purpose of using the project, the competent person, organization, or individual constructing and managing the project shall decide:

+ Increase the monitoring frequency every 1 hour for the works specified in (ii), (iii), (iv), (vii) and (ix);

- Increase the frequency of monitoring every 30 minutes during operation for the works specified in (vi).

(3) The project owner must conduct hydrometeorological monitoring and carry out the monitoring content as prescribed in (1) and (2).

For organizations and individuals that establish specialized hydrometeorological stations for monitoring according to their own needs and are not part of the project, they must decide on the appropriate monitoring content.

Specialized hydro-meteorological monitoring method from December 1, 2023 in Vietnam

- For specialized hydro-meteorological stations in construction projects, hydro-meteorological monitoring that must be carried out as specified in points (ii), (iii), (iv), (v), (vi), (vii) and (ix), project owners apply monitoring methods appropriate to monitoring equipment and technology but must ensure the accuracy of monitoring factors according to technical regulations and national technical regulations on hydro-meteorological monitoring.

- For the works specified in points (i), (viii), and (x), the project owner shall apply the regulations of the Ministry and branch.

- For specialized hydro-meteorological stations established by organizations or individuals to monitor according to their own needs that are not part of the project, the hydro-meteorological monitoring station must decide on the appropriate monitoring method.
