Regulations on soliciting opinions from employee representative organizations and employers at the local level in Vietnam

On October 06, 2014, the Ministry of Labor, War Invalids, and Social Affairs of Vietnam issued Circular 27/2014/TT-BLDTBXH providing guidelines for state labor management agencies to consult with labor representative organizations and employer representative organizations at the local level in the development of labor policies, laws, and labor relations issues.

Circular 27/2014/TT-BLDTBXH stipulates the principles, content, and forms of soliciting opinions from employee representative organizations, and employer representative organizations in localities (hereinafter referred to as the parties) by the state labor management agency in formulating labor policies, laws, and labor relation in Vietnam as follows:

1. Principles of soliciting opinions

The state labor management agency solicits opinions from provincial-level employee representative organizations and provincial-level employer representative organizations in formulating labor policies, laws, and labor relation issues, ensuring compliance with the law, democracy, honesty, and respect for the legitimate rights and interests of employees and employers.

2. Content of soliciting opinions

  • Labor policies and laws related to the duties, rights, and legitimate interests of employees and employers when requested by the Minister of Labor, Invalids, and Social Affairs to the Chairman of the Provincial People’s Committee.
  • Legal documents and guidance documents for the implementation of labor policies and laws issued by the Provincial People's Council and Provincial People’s Committee.
  • Solutions for developing labor relations in provinces and cities; measures to prevent and resolve labor disputes; periodic reports on the status of labor relations in localities.
  • Other issues as requested by the provincial-level People's Committee.

3. Forms of soliciting opinions

  • In writing;
  • Through working groups, steering committees, and research boards in which employee representative organizations and employer representative organizations participate;
  • Through meetings, seminars, forums, and consultation conferences attended by employee representative organizations and employer representative organizations.
