Regulations on sharing information on the national population database system in Vietnam (Internet image)
Circular 46/2022/TT-BCA was issued by the Minister of Public Security on November 4, 2022, regulating the connection, sharing, and exploitation of information between the National Population Database and national databases, specialized databases, and other information systems.
According to Clause 4, Article 3 of the Law on Citizen Identification 2014, national population database means a collection of basic information about all Vietnamese citizens, which is standardized, digitalized, stored and managed in an information infrastructure to serve state management work and transactions among agencies, organizations and individuals.
Pursuant to Clause 1, Article 4 of Circular 46/2022/TT-BCA, databases that share information about citizens with the National Population Database system according to the provisions of the law include:
- Shared electronic civil status database;
- Residence database;
- Citizen Identification Database;
- Medical database;
- Other specialized databases.
Specialized information associated with citizens (specified in Appendix I issued with Circular 46/2022/TT-BCA) when shared by agencies and organizations with the Ministry of Public Security:
The National Population Database Management Agency of the Ministry of Public Security is the receiving focal point to exploit and use for population management and meet other professional work requirements of Police units and localities according to assigned functions, tasks, and powers.
Citizens may look up and exploit information through the public service portal according to the provisions of Article 12 of Circular 46/2022/TT-BCA, as follows:
- Citizens log in to the public service portal.
- Citizens choose a lookup service or a personal information exploitation service.
- The Ministry of Public Security returns citizens' search results using information displayed on the public service portal or returns information exploitation results using Notice according to Form No. 01 issued with Circular 46/2022/TT-BCA.
Pursuant to Clause 1, Article 10 of Circular 46/2022/TT-BCA, agencies, organizations, and individuals that connect, share, and exploit information with the National Population Database have the following rights:
- Exploit and use information in the National Population Database according to functions, tasks, and purposes registered with the National Population Database management agency.
- Request the agency managing the national population database, the Ministry of Public Security, to resolve problems affecting the right to exploit and use information in the National Population Database.
In addition, the above agencies, organizations, and individuals also have the responsibilities specified in Clause 2, Article 10 of Circular 46/2022/TT-BCA, as follows:
- Comply with the provisions of Circular 46/2022/TT-BCA and legal regulations on the management, connection, sharing, and use of information;
- Exploit and use information in the National Population Database according to the allowed scope and consistent content for information sharing;
- Share information specified in Article 4 of Circular 46/2022/TT-BCA for the National Population Database.
- Timely notify the management agency of the National Population Database of the Ministry of Public Security about errors in information shared, exploited, or used.
- Coordinate with competent authorities and management agencies of the National Population Database to resolve problems in the process of connecting, sharing, exploiting, and using information in the National Population Database.
