Regulations on Re-Inspection of Health Inspectorate Conclusions Effective from February 27, 2015

On December 25, 2014, the Government of Vietnam issued Decree 122/2014/ND-CP on the organization and operation of Health Inspection.

Decree 122/2014/ND-CP regulates the re-inspection of health inspection conclusions as follows:

- The authority to re-inspect concluded cases but found to have signs of legal violations in the health sector is as follows:

- The Chief Inspector of the Ministry of Health decides to re-inspect cases that have been concluded by the Chairman of the Provincial People's Committee, the General Director, the Director of agencies assigned to perform specialized inspection functions under the Ministry of Health but found to have signs of legal violations when assigned by the Minister of Health;- The Chief Inspector of the Department of Health decides to re-inspect cases that have been concluded by the Head of the Sub-department under the Department of Health assigned to perform specialized inspection functions within the scope, authority of the Department of Health but found to have signs of legal violations when assigned by the Director of the Department of Health.

- The re-inspection decision includes the contents specified in Clause 1, Article 52 of the Law on Inspection. At the latest within 3 working days from the day of signing the re-inspection decision, the person making the re-inspection decision must send the re-inspection decision to the person who signed the inspection conclusion and the re-inspection subject.

- Re-inspection procedures, re-inspection time limits, re-inspection durations, roles and powers of the person making the re-inspection decision, Head of the Inspection Team, Inspection Team members, and re-inspection result report shall comply with the Law on Inspection, Decree 86/2011/ND-CP, and Decree 07/2012/ND-CP.

- The person making the re-inspection decision shall issue a re-inspection conclusion. The content of the re-inspection conclusion must comply with the provisions of inspection law.

- The re-inspection conclusion by the Chief Inspector of the Ministry of Health is sent to the Minister of Health and Chief Inspector of the Government of Vietnam; The re-inspection conclusion by the Chief Inspector of the Department of Health is sent to the Director of the Department of Health and Chief Inspector of the Ministry of Health.
