Regulations on providing and sharing information and environmental monitoring data in Vietnam (Internet image)
The Minister of Natural Resources and Environment promulgates Circular 15/2023/TT-BTNMT regulating the provision and sharing of information and data on natural resources and environmental monitoring (taking effect on December 15, 2023), which regulates the provision and sharing of information and environmental monitoring data in Vietnam as follows:
1. Model for connecting resource and environmental monitoring data
- Connection between national natural resources and environmental monitoring databases, field natural resources and environmental monitoring databases, provincial-level natural resources and environment monitoring database through the integration and data sharing platform of the Ministry of Natural Resources and Environment.
- Connection between the natural resources and environment monitoring database of ministries and branches and the national natural resources and environmental monitoring database through the national data sharing and integration platform or the Ministry of Natural Resources and Environment's data sharing and integration platform.
- Connect between the natural resources and environment monitoring databases of organizations and individuals with the national natural resources and environmental monitoring open database, an open database for monitoring natural resources and the environment at the provincial level through the data integration and sharing platform of the Ministry of Natural Resources and Environment and the provincial data integration and sharing platform.
2. Connect and share natural resources and environmental monitoring data between state agencies
- Connect and share resource and environmental monitoring data in the default form, including data specified in Articles 6, 7, and 8 of Circular 15/2023/TT-BTNMT.
- Connect and share resource and environmental monitoring data according to specific requirements in compliance with regulations in Decree 47/2020/ND-CP.
- Methods of connecting and sharing natural resources and environmental monitoring data:
+ Use data services as a method to connect information systems with the Resource and Environmental Monitoring Database (RESTful API standard);
+ The packet structure uses the JSON (JavaScript Object Notation) format.
- Ministry of Natural Resources and Environment:
+ Assign the Department of Digital Transformation and Environmental Resources Data Information to build default shared data services and connect to the data sharing and integration platform of the Ministry of Natural Resources and Environment and the national data sharing and integration platform; Provide guidance and technical support for connecting and sharing natural resources and environmental monitoring data;
+ Units under the Ministry of Natural Resources and Environment are assigned to manage the natural resources and environment monitoring database, organize the connection, and provide default shared data from the field resource and environment monitoring database through the integration and data sharing platform of the Ministry of Natural Resources and Environment.
- Ministries and branches that have information and monitoring data on natural resources and the environment shall connect and share data through the national data sharing and integration platform.
- Provincial People's Committees connect and provide default sharing data from the Provincial Natural Resources and Environment Monitoring Database through the data integration and sharing platform of the Ministry of Natural Resources and Environment.
3. Exploit and use information and environmental monitoring data
- Organizations and individuals have the right to exploit and use information and environmental monitoring data according to regulations.
- In case information and data from the natural resources and environmental monitoring databases are exploited in the electronic environment through the Data Portal in the form of data services, proceed as follows:
+ Organizations and individuals requesting to use the service must follow the instructions on the Data Portal and be authenticated through the Electronic Identification and Authentication System;
+ Exploit and use information and data in accordance with the commitment to use data services and instructions of the data provider;
+ In the process of exploiting and using information and data, if there are any difficulties or problems, organizations and individuals must notify and report to the agency managing the natural resources and environmental monitoring database according to the provisions of Article 10 of Circular 15/2023/TT-BTNMT.
4. Provide open data for monitoring resources and the environment
- Open data on natural resource and environmental monitoring is provided on the Data Portal of ministries, branches, and localities through data sharing or packaging services and is available for organizations and individuals to download and use.
- The list of open data for natural resource and environmental monitoring must be reviewed and revised (if any) according to the actual situation and periodically; open data published according to categories must be updated or supplemented (if any) within no more than 03 months from the time of publication.
- Receive feedback from organizations and individuals on the Data Portal to determine priorities and publish open data in accordance with needs.
- Exploit and use open data for natural resource and environmental monitoring in compliance with regulations in Article 18 of Decree 47/2020/ND-CP.
5. Ensure information security in providing and sharing information and environmental and resource monitoring data
- Component systems specified in Clause 1, Article 5 of Circular 15/2023/TT-BTNMT must ensure information system security according to the level specified in Decree 85/2016/ND-CP of the Government. on ensuring information system security by level; Circular 12/2022/TT-BTTTT of the Minister of Information and Communications.
- Component systems specified in Clause 1, Article 5 of Circular 15/2023/TT-BTNMT must have a plan to ensure information security to meet the requirements for ensuring information system security according to the corresponding level determined as prescribed in Circular 12/2022/TT-BTTTT; There must be an information security monitoring plan that meets the regulations in Circular 31/2017/TT-BTTTT of the Minister of Information and Communications regulating information system safety monitoring activities.
- Component systems specified in Clause 1, Article 5 of Circular 15/2023/TT-BTNMT must be inspected and assessed for information security before being put into use.
The content, frequency, and form of information security inspection and assessment comply with the provisions of law on ensuring information system security by level, according to the approved information security plan specified in Circular 12/2022/TT-BTTTT.
