Regulations on prohibited acts when participating in road traffic in Vietnam

This is a notable content of the Draft Law on ensuring road traffic order and safety, which was submitted to the National Assembly of Vietnam for consideration.

According to the Draft Law on ensuring road traffic order and safety of Vietnam, prohibited acts when participating in road traffic are specified as follows:

- Operating a vehicle in road traffic with drugs or other stimulants banned by law in the body.

- Operating a motor vehicle without a valid driver's license. Operating a special-use motorcycle participating in road traffic without a certificate of training in road traffic law knowledge, a license or a certificate for operating special-use motorbikes.

- Operating a motor vehicle exceeding the limited speed; go to the wrong part of the road or lane; avoid or exceed the regulations.

- Going against the traffic direction on a freeway, backing up on a freeway, except for emergency vehicles on duty;

- Operating motorcycles, mopeds (including electric motorbikes), motorcycle-like vehicles and moped-like vehicles entering a freeway, except for the vehicles serving the management and maintenance of the freeway.

- Operating a transport business car for more than 4 consecutive hours and more than 10 hours in a day.

- Continuously honking, revving up the engine; using air horns, honking from 10 pm to 5 am, using the high beam in rural areas or residential areas, except for emergency vehicles on duty as prescribed in this Law.

- Racing, cheering for racing, organizing illegal racing, swerving, swinging.

- Run away after causing an accident to avoid responsibility.

- Transporting goods banned from circulation, illegally transporting or failing to fully comply with regulations on transportation of dangerous goods and wild animals.

- Using a cell phone with hands while operating the vehicle on public roads.

- Hand over motor vehicles and special-use motorcycles to people who are not qualified to operate vehicles participating in road traffic.

- Installing and using horns and lights not in accordance with the manufacturer's design for each type of motor vehicle; using audio equipment to cause disturbance to traffic safety and public order; mounting motor vehicle license plates in the wrong position or covering or gluing all or part of license plates when participating in traffic.

- Deliberately cutting, welding and punching to modify chassis number and engine number; operating vehicles whose chassis number and engine number have been modified due to being cut, welded and punched.

- Falsifying or forging the documents about vehicle registration.

- Changing the chassis, engine, shape, size, or functions of the vehicle.

- Providing false information or using fraudulent documents to apply for the license plate or Certificate of vehicle registration.

- Operating vehicles without certificates of vehicle registration or with expired certificates of vehicle registration.

- Operating road motorized vehicles that do not meet technical safety and environmental protection standards to participate in road traffic.

- Placing, leaving unauthorized obstacles on the road; spreading nails or other pointed objects on public roads, spilling oil or other slippery substances on public roads; stretching strings or placing obstacles on public roads that threaten people and vehicles in traffic.

- Throwing stones, dirt, or other objects at a vehicle running on public roads.

- Illegally using roadbeds, curbs and sidewalks; illegal gatherings of people obstructing traffic.

- Obstructing or failing to comply with inspection and control requests of law enforcement officers.

- Deliberately altering or destroying accident scenes.

- Illegally producing, using, buying and selling license plates of motor vehicles and special-use vehicles (except for the case of buying and selling license plates of winning cars at auction).

-  Deliberately refusing to rescue victims of traffic accidents when having conditions to do so.

- Infringing upon the lives, health and property of traffic accident victims and causers.

- Taking advantage of traffic accidents to assault, intimidate, incite, pressure, foment disorder or obstruct the handling of traffic accidents.

- Abusing one’s position, power or profession to breach the road traffic law.

- Acts of breaching road traffic rules and other acts endangering road users and vehicles in road traffic.
