Regulations on policies for servicemen and national defense public employees who sacrifice their lives or pass away

Recently, the Government of Vietnam promulgated Decree 151/2016/ND-CP detailing and guiding the implementation of certain provisions regarding policies of the Law on Professional Military Personnel, Workers, and Defense Public Employees.

According to Decree 151/2016/ND-CP, policies regarding professional soldiers, defense workers, and public employees serving in the military who sacrifice their lives or pass away as stipulated in clauses 2, 3 of Article 42 of the Law on Professional Soldiers, Defense Workers, and Public Employees are implemented as follows:

- Professional soldiers, defense workers, and public employees serving in the military who sacrifice their lives, if eligible under the legal provisions on preferential treatment for people with meritorious services to the revolution, will be considered for recognition as martyrs; the relatives of professional soldiers, defense workers, and public employees will receive benefits and policies according to the laws on preferential treatment for people with meritorious services to the revolution, social insurance laws, and a one-time allowance, with each year of service receiving an allowance equal to one month's salary of the month immediately preceding the sacrifice.

- Professional soldiers, defense workers, and public employees serving in the military who pass away, their relatives will receive benefits and policies according to the laws on social insurance and a one-time allowance, with each year of service receiving an allowance equal to one month's salary of the month immediately preceding the death.

Relatives of professional soldiers, defense workers, and public employees eligible for the one-time allowance include: spouses; biological parents; legal guardians; biological children, and legally adopted children.
