Regulations on Policies for Exemption and Reduction of Quality Inspection of Imported Fertilizers

Currently, the state inspection agency for the quality of imported fertilizers is the Plant Protection Department or a certification organization with a testing laboratory that meets the regulations according to Decree 74/2018/ND-CP dated May 15, 2018, of the Government of Vietnam, amending and supplementing certain articles of Decree 132/2008/ND-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality, Decree 154/2018/ND-CP and authorized by the Plant Protection Department in each phase.

Clause 3 Article 21 Decree 84/2019/ND-CP stipulates policies for exemption from quality inspection of imported fertilizers as follows:

- The exemption from inspection applies to: Fertilizers of the same name, fertilizer code, fertilizer type from the same manufacturing facility, same origin, and same importer, after 3 consecutive instances of state inspection results meeting the import quality requirements. The quantity of each subsequent import should not exceed the total quantity of the 3 consecutive imports used as the basis for exemption from inspection.- The exemption period is 12 months. The frequency of sample testing according to the provisions of point c clause 2 Article 21 for fertilizers subject to exemption policies is up to 20% within one year, randomly selected by the inspection body.- During the exemption period, the importer submits the application for state inspection as specified in point a clause 1 Article 21 to the state inspection agency for the quality of imported fertilizers according to the provisions of clause 4 Article 21. The inspection agency only samples quality inspection according to the frequency specified in point b clause 3 Article 21. If no sample is taken for quality inspection, within 2 days of receiving a valid application, the state inspection body shall notify the state inspection results of the quality of imported fertilizers to the organization or individual according to Form No. 18 in Appendix I issued together with this Decree.- The application dossier and procedures for exemption from inspection shall comply with Decree 74/2018/ND-CP and Decree 154/2018/ND-CP dated November 09, 2018, amending and supplementing certain regulations.
