On November 27, 2023, the National Assembly passed the Law on Identification 2023.
Article 12 of the Law on Identification 2023 provides the following regulations on the personal identification number for Vietnamese citizens:
The personal identification number for Vietnamese citizens is a natural sequence of 12 digits established by the national population database for Vietnamese citizens.
The personal identification number for Vietnamese citizens is uniformly managed nationwide by the Ministry of Public Security and is unique to each citizen, not repeated for another individual.
The personal identification number for Vietnamese citizens is used for issuing identity cards and for accessing information about citizens in the national population database and various national databases, specialized databases, national data centers, public service portals, and administrative procedure resolution information systems.
According to Article 11 of Decree 70/2024/ND-CP on guidelines for establishment, cancellation and re-establishment of a personal identification number of a Vietnamese citizen:
Each Vietnamese citizen, when information is collected into the national population database, is assigned a unique personal identification number by the identity management authority of the Ministry of Public Security, which does not duplicate any other.
Establishing a personal identification number for citizens registering for birth:
The birth registration authority and the electronic civil registration data management authority are responsible for transferring the information of the person registering for birth to the national population database through data connection, sharing, and synchronization; the information collected must include:
The national population database system receives birth registration information from the electronic civil registration database, automatically checks it, establishes the personal identification number, and immediately transfers it to the birth registration authority. If errors in information provided by the electronic civil registration database occur, adjustments will be made according to Clause 2, Article 6 of Decree 70/2024/ND-CP.
Establishing a personal identification number for citizens who have already registered for birth:
Information collection for Vietnamese citizens residing abroad will be conducted through the Information Collection Form by the identity management authority via the Vietnamese representative agency abroad. The representative agency will send the completed Information Collection Form to the identity management authority of the Ministry of Public Security for updating into the national population database;
For citizens who have registered for birth but have not been issued a personal identification number, the commune police where the citizen resides are responsible for collecting and updating the citizen's information as stipulated in Clause 6, Article 5 of Decree 70/2024/ND-CP. The head of the identity management authority of the Ministry of Public Security will establish the personal identification number for the citizen based on the collected and updated information in the national population database;
For citizens who have registered for birth and are currently residing abroad without a personal identification number, the identity management authority of the Ministry of Public Security, in coordination with the Ministry of Foreign Affairs and relevant agencies, will collect and update the citizen’s information in the national population database and establish their personal identification number;
For foreigners who have been granted Vietnamese nationality, the Ministry of Justice is responsible for transferring information about the granting of Vietnamese nationality and relevant information specified in Clause 2, Article 11 of Decree 70/2024/ND-CP to the identity management authority of the Ministry of Public Security for information collection, update into the national population database, and establishment of personal identification numbers.
In cases where an individual has been stripped of Vietnamese nationality, renounced Vietnamese nationality, or had their Vietnamese nationality grant revoked, but is re-granted Vietnamese nationality by the competent authority, the identity management authority is responsible for re-establishing and reissuing the personal identification number.
Cases for cancelling and re-establishing personal identification numbers:
Re-determination of gender, rectifying civil status due to errors in the year of birth according to civil registration laws and other relevant laws;
Errors regarding the place of birth registration, year of birth, or gender information collected into the national population database;
The identity management authority discovers and handles actions involving the use of fake documents, papers, or data, providing false information or documents to be collected and updated into the population database, issuing identity cards, or citizen ID cards;
The civil registration authority revokes and cancels illegally issued birth certificates.
The cancellation and re-establishment of personal identification numbers in cases specified in points a and b, Clause 7, Article 11 of Decree 70/2024/ND-CP will be based on citizens’ requests. If a citizen does not request the cancellation and re-establishment of their personal identification number, they can continue using their current personal identification number.
The identity management authority has the responsibility to coordinate with relevant agencies and organizations to examine, verify, and cancel or re-establish personal identification numbers in cases stipulated in points c and d, Clause 7, Article 11 of Decree 70/2024/ND-CP.
Citizens requesting the cancellation and re-establishment of their personal identification number as per points a and b, Clause 7, Article 11 of Decree 70/2024/ND-CP must complete and submit the Personal Identification Request Form via the National Public Service Portal, the Ministry of Public Security Public Service Portal, the National Identification Application, or directly at the commune police station where the citizen resides.
Within 10 days from receiving the cancellation and re-establishment request documents, the commune police where the documents were received are responsible for verifying and validating the documents' accuracy, and then submitting the request to the identity management authority of the Ministry of Public Security through the national population database system.
Within 5 working days from the receipt of the cancellation and re-establishment request from the commune police, the identity management authority or the head of the identity management department of the Ministry of Public Security will decide on the cancellation and re-establishment of the personal identification number. After the citizen's personal identification number is canceled and re-established in the national population database, the commune police will notify the citizen in writing. The canceled personal identification number is retained in the citizen's information in the national population database and must not be reissued to another individual.
