The amended 2008 Law on Officers of the Vietnam People's Army revised and supplemented several articles of the 1999 Law on Officers of the Vietnam People's Army. The regulations on officers ceasing active service have also undergone changes.
To be specific, according to the provisions of Clause 11, Article 1 of the amended Law on Officers of the Vietnam People's Army 2008, amending and supplementing Article 35 of the Law on Officers of the Vietnam People's Army 1999, officers are to cease active duty service under the following cases:
- Meeting the conditions for retirement;- Reaching the age limit for active duty service;- Due to organizational and structural changes that no longer require the officer, professional military personnel, or national defense official;- No longer meeting the stipulated standards for active duty officers.
Officers cease active duty service in one of the following forms:
- Retirement;- Sector transfer;- Demobilization;- Discharge according to war invalids policies.
Upon ceasing active duty service, if meeting the standards and not exceeding the age limit for reserve officers, they shall be transferred to the reserve officers' corps.
