On November 26, 2024, the National Assembly of Vietnam passed the Notarization Law 2024 replacing the Notarization Law 2014.

Regulations on notary practice apprenticeship in Vietnam from July 1, 2025

According to Article 12 of the Notarization Law 2024, regulations on notary practice apprenticeship are as follows:

(1) Individuals with a certificate of graduation from a notarial training course must contact a notary practice organization as prescribed in Clause (2) for a notarial apprenticeship; if unable to contact for apprenticeship, they should request the Department of Justice to arrange the apprenticeship.

The apprentice must register for apprenticeship at the Department of Justice in the locality where the notary practice organization accepting the apprentice is located.

The duration of the notarial apprenticeship is 12 months, calculated from the effective date of the apprenticeship registration decision.

(2) The notary practice organization accepting the apprentice must have a notary meeting the conditions for guiding the apprenticeship as prescribed in Clause 3 of this Article and must have the infrastructure to support the apprenticeship.

(3) A notary assigned to guide the apprenticeship must have at least 2 years of experience in notary practice. A notary who has been subject to disciplinary action, or administrative penalty in notary practice can only guide apprentices after 12 months from the date of completing the disciplinary decision or administrative penalty decision.

If a notary guiding an apprentice is subject to disciplinary action, administrative penalty in notary practice, temporarily suspended from practice, deceased, or declared deceased or missing by the court, the notary practice organization will assign another qualified notary to continue guiding the apprenticeship.

If there are no longer any qualified notaries to guide the apprenticeship, the notary practice organization must report to the Department of Justice to appoint another notary practice organization to take the apprentice.

At any one time, a notary may guide a maximum of 2 apprentices.

The notary guiding the apprenticeship must instruct and be responsible for the work performed by the apprentice under their guidance.

(4) The individual undergoing a notarial apprenticeship must ensure adherence to the working days and hours of the notary practice organization accepting the apprentice; they must be guided in professional skills and undertake work related to notarization and certification as assigned by the guiding notary and are accountable to the guiding notary for such work.

(5) Individuals who have completed the apprenticeship may register for the notary practice apprenticeship result examination; if they meet the examination requirements, they are granted a certificate of notary practice apprenticeship exam results.

The certificate of notary practice apprenticeship exam results has no expiration date, except in the case that within 5 years from the date of issuance of the exam result certificate, the holder does not apply for notary appointment, then the certificate expires; a person whose notary practice apprenticeship exam result certificate has expired must register for and meet the examination requirements to be appointed as a notary.

The Minister of Justice of Vietnam shall detail this Article.

The Notarization Law 2024 is effective from July 1, 2025.
