Regulations on Mobilizing Reserve Forces

The reserve force comprises reserve servicemen and technical means that have been arranged in the plan to supplement the standing force of the military. So, what does the law stipulate about the mobilization of the reserve force?

As stipulated in the 1996 Ordinance on Mobilization of Reserve Forces, the contents of mobilizing reserve forces include:

- Notification of the mobilization order for reserve forces;- Concentration of reserve military personnel and technical equipment;- Transportation and handover of reserve forces;- Implementation of Party work and political work;- Implementation of logistic support work, technical equipment, and financial assurance.

Reserve forces are mobilized in the following cases:

- To supplement the standing army forces upon issuance of a general mobilization order or partial mobilization order and during wartime;- To reinforce the standing army forces when there is a need for combat to protect localities, protect territorial sovereignty without reaching the level of partial mobilization.

Regarding the authority to mobilize reserve forces upon issuance of a general mobilization order or partial mobilization order and during wartime, the Ordinance specifically stipulates as follows:

- The Government of Vietnam decides on the mobilization of the number of reserve military personnel, technical equipment, and decides on the transfer of the number of technical equipment from the national reserves to the Ministry of National Defense;- Based on the decision of the Government of Vietnam, the Minister of National Defense issues mobilization orders for reservist units in each province, centrally-administered city, each Ministry, Ministerial-level agency, and Government-attached agency;- The authority to call reserve military personnel for enlistment is as prescribed in the Law on Military Service and the Law on Officers of the Vietnam People's Army;- Based on the decision of the Government of Vietnam and the order of the Minister of National Defense:- Ministers, Heads of Ministerial-level agencies, and Heads of Government-attached agencies decide to mobilize technical equipment in reserve units built by their respective agencies;- Chairpersons of provincial People's Committees mobilize the number of technical equipment in reserve units built by their localities; Chairpersons of district People's Committees decide to mobilize each technical equipment;- The authority to requisition and commandeer technical equipment is implemented in accordance with the provisions of the law.
