Regulations on minimal operations and processes for originating good in Vietnam

Recently, the Ministry of Industry and Trade issued Circular 40/2015/TT-BCT implementing the Rules of Origin under the Vietnam - Korea Free Trade Agreement.

At Article 8 of Appendix I, Rules of Origin issued together with Circular 40/2015/TT-BCT, it is stipulated that goods are not considered to have origin in the territory of a member country if the following minimal operations and processes are carried out separately or in combination within the territory of that member country. The details of these stages are as follows:

- The stages of preserving goods in good condition during transport and storage;

- Changing packaging, dismantling and assembling packages;

- Minimal washing, cleaning, dust removal, oxide removal, oil, paint, or other surface coatings;

- Ironing or straightening fabric;

- Minimal painting and polishing stages;

- Milling, husking, partial or complete bleaching, polishing, and glazing cereals and rice;

- Coloring sugar or forming sugar blocks;

- Minimal peeling, seeding, or husking;

- Minimal sharpening, grinding, or cutting;

- Sieving, screening, selecting, sorting, grading, or grouping;

- Minimal packing into bottles, cans, molds, bags, sacks, boxes, selecting covers, and other minimal packaging stages;

- Affixing or printing labels, marks, or logos, and similar distinguishing signs on products or their packaging;

- Minimal mixing of products, whether of the same or different kinds;

- Minimal assembling of product parts to create a complete product or disassembling a product into individual parts;

- Minimal inspection or testing; or

- Slaughtering animals.

Note: Goods with origin in the territory of a member country retain their original origin when exported from the other member country, where the minimal operations and processes as regulated above are carried out.
