Regulations on Medical Examination, Accident, and Sickness Treatment for Reserve Military Personnel 2020

This is an important regulation in Decree 79/2020/ND-CP concerning policies in the construction and mobilization of reserve forces.

To be specific:, Article 6 of Decree 79/2020/ND-CP stipulates that reservists who are not subject to social insurance and health insurance as per Clause 6, Article 30 of the Law on Mobilization Reserve Forces (referred to as the Law) during training, exercises, readiness checks, mobilization for combat readiness, and mobilization when not at the level of general or partial mobilization, if becoming ill, injured, or deceased, are to be handled as follows:

First, policies on medical examination and treatment

They are entitled to medical examinations and treatment at military and civilian medical facilities; covered for medical examination and treatment costs, and hospital meal expenses based on the receipt (if hospitalized); if the treatment extends beyond the training, exercise, readiness check, or mobilization period, they are covered for medical examination and treatment costs and hospital meal expenses for up to 15 days.

Second, policies on accident allowance

- Eligibility for allowance

Reservists injured and assessed by a provincial or equivalent medical examination council with a labor capacity reduction of 5% or more are entitled to allowances in cases such as: commuting between home and the training center, or returning home after training; during working hours and at the task location; outside working hours and the task location when performing tasks at the request of an authorized commander.

- Allowance rate

A 5% reduction in labor capacity is compensated with a one-time allowance of 8,000,000 VND; for each additional 1% reduction, an extra 800,000 VND is added.

Third, policies on allowances for cases of death due to accidents or illness, accidental injuries

- For death due to accidents, the family receives a one-time allowance of 57,600,000 VND; the next of kin or the person organizing the funeral receives a funeral allowance of 16,000,000 VND.

- For death due to illness, accidental injuries, the family receives a one-time allowance of 4,800,000 VND; the next of kin or the person organizing the funeral receives a funeral allowance of 16,000,000 VND.

Note: All the above policies and allowances do not apply to reservists who become ill, injured, or deceased due to the following reasons:

- Due to personal conflicts with the person causing the accident unrelated to the unit’s tasks or duties.- Due to intentional self-harm; intoxication from alcohol; violation of military discipline or state law.- Due to using narcotics, addictive substances, psychoactive substances, illegal narcotic drugs, or psychotropic drugs.

The unit directly responsible for training, exercises, readiness checks, combat readiness, and mobilization must cover the costs and ensure the implementation of these policies for reservists and their families.
