Regulations on management and use of foreign funding are under the management authority of the Ministry of Natural Resources and Environment in Vietnam 

Decision 2742/QD-BTNMT of 2023 on Regulations on management and use of foreign funding under the management authority of the Ministry of Natural Resources and Environment.

Issued together with this Decision is the Regulation on the Management and Use of foreign aid capital under the management authority of the Ministry of Natural Resources and Environment.

Decision 2742/QD-BTNMT takes effect from the date of signing (September 22, 2023), replacing Decision 2538/QD-BTNMT of 2018 of the Minister of Natural Resources and Environment promulgating Regulations on management and use of foreign aid capital under the management authority of the Ministry of Natural Resources and Environment.

This Regulation regulates the development, appraisal, approval, implementation, monitoring, and evaluation of programs and projects (hereinafter abbreviated as projects) using foreign funding under the management authority of the Ministry of Natural Resources and Environment.

Foreign funding specified in this regulation includes official development assistance (ODA) and preferential loans from foreign sponsors according to the provisions of Decree 114/2021/ND-CP. Non-refundable aid is not part of the official development support of foreign agencies, organizations, and individuals for Vietnam according to the provisions of Decree 80/2020/ND-CP.

This regulation applies to all units under the Ministry of Natural Resources and Environment, organizations, and individuals related to projects using foreign funding under the management authority of the Ministry of Natural Resources and Environment.

Principles of management and use of foreign aid

- Activities related to the management and use of foreign funding must comply with the provisions of Decree 114/2021/ND-CP, Decree 20/2023/ND-CP, Decree 80/2020/ND-CP, Decree 113/2014/ND-CP, and related legal regulations.

- Projects using foreign funding developed by units under the Ministry of Natural Resources and Environment must be consistent with the Government's general orientation on attracting, managing, and using ODA capital and concessional loans. In each period, consistent with industry or field development plans and strategies; medium-term and long-term plans; and priority orientations in the fields of state management of the Ministry of Natural Resources and Environment; consistent with the functions, tasks, needs, and capacity of receiving capital, technology, and experience in managing and using funding of the proposing unit.

- The International Cooperation Department presides over and coordinates with relevant units to develop plans to attract ODA capital and preferential loans and cooperate with foreign sponsors annually to submit to the Minister for consideration, decision, and implementation.

- Projects using foreign funding under the management authority of the Ministry of Natural Resources and Environment must be approved by competent authorities to be eligible for implementation.

- The Ministry of Natural Resources and Environment is the managing agency for all projects using foreign funding managed by the Ministry.

- Specialized projects in the fields of state management under the Ministry of Natural Resources and Environment will be owned by units under the Ministry (budget-using units); Other projects implemented by units under the Ministry Office block will be project-owned by the Ministry Office and reported to the Deputy Minister directly in charge of the unit under the Ministry Office block for direction and resolution.

- Technical assistance projects using non-refundable ODA capital prepare investment projects according to regulations for other technical assistance projects.
