On March 13, 2018, the Government of Vietnam promulgated Decree 45/2018/ND-CP regulating the management, usage, and exploitation of inland waterway transportation infrastructure assets.
Decree 45/2018 clearly states: Inland waterway traffic infrastructure assets must be maintained in accordance with legal regulations, ensuring compliance with procedures, processes, plans, and standards, as well as norms to maintain the technical status of the assets, and ensure normal and safe operation when used and exploited.
There are the following forms of maintenance for inland waterway traffic infrastructure assets:
Maintenance according to quality performance:
- This refers to performing maintenance activities according to specified quality standards, within a certain period with a specified amount of money stipulated in the Economic Contract.- The agency assigned to manage the assets is responsible for determining the lump sum maintenance price for each asset within the assigned management scope; submitting it to the competent authority for approval. The lump sum maintenance price for inland waterway traffic infrastructure assets is determined according to the economic-technical norm method of maintenance activities or the average cost method of the previous 3 consecutive years of maintenance activities, plus the inflation factor (if any), or a combination of both methods.- The Ministry of Transport stipulates the criteria for monitoring and acceptance of maintenance results of inland waterway traffic infrastructure assets according to the quality performance.
Maintenance according to actual volume:
Maintenance according to actual volume refers to performing maintenance activities and getting paid according to the actual volume of work done.
Maintenance combined with product recovery:
- This refers to the State assigning enterprises to dredge and maintain inland waterway channels, combined with product recovery to pay for maintenance costs. This form of maintenance is applied to dredging and maintaining inland waterway channels with recoverable products.- Maintenance combined with product recovery must be formulated into a project and organized for implementation according to the provisions of the public investment law and the law on bidding.
According to Decree 45, the funding for maintaining inland waterway traffic infrastructure assets is allocated from the state budget and other financial sources as prescribed by law and specifically excludes the following cases:
- Inland waterway traffic infrastructure assets that have been included in state capital at the enterprise;- Inland waterway traffic infrastructure assets during the lease period for exploitation rights, where the enterprise leasing the exploitation rights undertakes maintenance according to the signed Contract;- Inland waterway traffic infrastructure assets during the term transfer period of exploitation rights, where the enterprise receiving the transfer undertakes maintenance according to the signed Contract.
