Regulations on Leave Policies for the Armed Forces in 2018

Officers, non-commissioned officers, soldiers, professional military personnel, defense workers, and defense public employees are entitled to leave according to the regulations stipulated in Circular 113/2016/TT-BQP, Circular 153/2017/TT-BQP, and Decree 27/2016/ND-CP. The specific leave policy is as follows:

Leave Regulations for Active Duty Officers, Professional Soldiers, Workers, and National Defense Public Employees

Weekly Leave

Entitled to leave on Saturdays and Sundays. In cases where due to special nature and duties they cannot take leave on Saturday or Sunday, the unit commander will arrange compensatory leave on other days of the week.

Annual Leave

The number of annual leave days depends on the number of years of active service:

- Less than 15 years of service: 20 days of leave;- From 15 years to less than 25 years of service: 25 days of leave;- From 25 years and above: 30 days of leave.

In cases where the unit is stationed far from the family, additional leave days are allowed:

- Stationed 500 km or more from the family or on islands in the Truong Sa archipelago, DK: additional 10 days of leave per year;- Stationed between 300 km and under 500 km from the family; stationed in deep-lying, remote areas, border areas between 200 km and under 300 km from the family, and currently receiving area allowance at a coefficient from 0.5 to 0.7, or on islands receiving area allowance from 0.1 to under 1.0: additional 5 days of leave per year.

Special Leave

Officers, professional soldiers, workers, and national defense public employees are entitled to special leave not exceeding 10 days in the following cases:

- Marriage; legal child or adopted child's marriage;- Natural parents; parents-in-law; legal guardians of self, spouse; spouse; legal child or adopted child's death or serious illness, accident requiring long-term treatment at medical facilities;- Family suffering serious human and property loss due to accidents, natural disasters, dangerous epidemics.

Holiday Leave

Leave on holidays according to Clause 1, Article 115 of the Labor Code 2012 and the Vietnam People's Army establishment day (December 22).

In cases where holidays coincide with weekly leave, professional soldiers, workers, and national defense public employees are entitled to compensatory leave on subsequent days.

Convalescence and Recovery Leave

Professional soldiers, workers, and national defense public employees are entitled to convalescence and recovery leave as stipulated in Circular 179/2013/TT-BQP.

Retirement Preparation Leave

The retirement preparation leave policy for soldiers is as follows:

- From 20 years to under 25 years of social insurance contribution: 9 months of leave;- From 25 years of social insurance contribution and above: 12 months of leave.

During retirement preparation leave, if afflicted with a severe illness, long-term treatment illness, or mental illness, the leave is guided by Circular 157/2013/TT-BQP and Circular 70/2016/TT-BQP.

Sick leave and maternity leave policies for officers, professional soldiers, workers, and national defense public employees.

Leave Regulations for Non-commissioned Officers and Soldiers on Active Duty

Non-commissioned officers and soldiers on active duty from the thirteenth month onwards are entitled to annual leave; the leave duration is 10 days (excluding travel days) and they are reimbursed for travel expenses and travel allowances according to current regulations.

Non-commissioned officers and soldiers who are students at academies and schools both within and outside the Army, with a study duration of one year or more, enjoy summer vacation between the two academic years, and this time is counted as annual leave and reimbursed for travel expenses and travel allowances according to current regulations.

In special cases requiring combat duty, readiness for combat, or in areas with difficult travel conditions where leave cannot be arranged, reimbursement in cash is provided. The reimbursement for one day of ungranted leave equals one day of basic subsistence for non-commissioned officers and infantry soldiers.

Non-commissioned officers and soldiers who have taken annual leave according to policies, but whose families suffer from severe natural disasters, fires, or the death, disappearance of natural parents; parents-in-law; legal guardians; spouse, or legal child, or who achieve exceptional achievements in fulfilling duties, are entitled to special leave not exceeding 5 days (excluding travel days) and reimbursed for travel expenses and travel allowances according to current regulations.
