The following article contains information regarding regulations on Land for road protection and maintenance in Vietnam from January 1, 2025, as stipulated in the Law on Road 2024.

According to the provisions in Article 14 of the Road Law 2024, the land designated for the protection and maintenance of roadways is as follows:

- The width of the land for the protection and maintenance of roadways outside urban areas depends on the technical class of the roadway and is determined by the following principles:

+ For roadways with an embankment, the land for protection and maintenance is determined from the bottom of the embankment slope outward;

+ For roadways with a cut slope, the land for protection and maintenance is determined from the outermost edge of the top ditch outward; where there is no top ditch, it is determined from the outermost edge of the slope's vertical cut;

+ For bridges, culverts, ditches, inlets, and other roadway structures, the land for protection and maintenance is determined from the outermost structural component of the project outward; for viaducts and overpasses, the land for protection and maintenance is determined from the outermost foundation of the abutments, piers, or bridge structure;

+ For cases not covered by points a, b, and c of Clause 1, Article 14 of the Road Law 2024, the Land for road protection and maintenance lies along the outer edge and enough distance for constructing drainage channels, no less than 1 meter.

- The land for the protection and maintenance of urban roads is determined by the following principles:

+ For urban roads with sidewalks, a portion of the sidewalk is used for the protection and maintenance of urban roads;

+ For urban roads adjacent to residential walls, other construction walls, roads without sidewalks, roads in alleys, narrow paths, and internal roads within urban residential areas, a portion of the roadway is employed for protection and maintenance;

+ For cases not covered by points a and b of Clause 2, Article 14 of the Road Law 2024, it is determined similarly to roads outside urban areas;

+ The land for the protection and maintenance of bridges, culverts, ditches, inlets, and other urban roadway structures is determined according to point c of Clause 1, Article 14 of the Road Law 2024. For circumstances where these structures are contiguous with other constructions, the land for protection and maintenance is the boundary line of the structures.

- For overlapping or intersecting roadway sections, the land for protection and maintenance is determined by the higher technical grade road; for adjacent roads, the land is determined from the outermost edge of the outer road outward.

- Where the land for the protection and maintenance of roadways overlaps with railway land, the use of land for roadway protection and maintenance must not affect traffic safety and railway structural integrity.

- Where the land for the protection and maintenance of roadways overlaps with flood protection, the use of land for roadway protection and maintenance must not impact flood protection operations and safety. If it overlaps with water conservancy projects, the land use must not affect the operation and safety of these projects. If impacted, the road management entity, users, owners, or managers of the water conservancy project must provide remedial measures ensuring the safety of both the roadway and the water conservancy project.

- The land for the protection and maintenance of tunnels, ferry ports, pontoon bridges, embankment structures, or retaining walls is determined as follows:

+ The land for the protection and maintenance of road tunnels depends on the tunnel project's classification and is determined from the outermost part of the main tunnel entrance, auxiliary entrances, ventilation shafts, and other related structures outward;

+ The land for the protection and maintenance of ferry ports depends on the ferry project's classification and is determined from the outermost part of the descent road, and related structures; the land for the protection and maintenance of pontoon bridges is from the outermost part of the descent road and abutments, piers of the pontoon bridge;

+ For roadways where the protection and maintenance land overlaps with inland navigation projects, the protection and maintenance boundary of the roadway is the foundation edge of the road and related roadway structures;

+ The land for the protection and maintenance of embankment structures and retaining walls is determined from the outermost part of the structure outward.

For further information, refer to the Road Law 2024, which comes into force in Vietnam from January 1, 2025, except for points a and b of Clause 2, Article 42, Article 43, Article 50, Clause 1 of Article 84 of the Road Law 2024, which are effective in Vietnam from October 1, 2024.
