Regulations on land allocation with land levy and land lease in the Border-gate Economic Zone in Vietnam

On December 31, 2007, the Ministry of Finance issued Circular 162/2007/TT-BTC providing guidance on financial policies and customs procedures applicable to the border-gate economic zone of An Giang province in Vietnam.

Circular 162/2007/TT-BTC stipulates the policies on land allocation with land levy and land rent in the Border-gate Economic Zone of An Giang Province in Vietnam as follows:

- Organizations and individuals using land in the Border-gate Economic Zone of An Giang Province are allowed to invest in the construction of infrastructure, production, business, and have corresponding rights and obligations depending on the form of land allocation or land lease in accordance with the law on land;

- Policies on a single land rent price are applied to organizations, individuals, and enterprises renting land, regardless of whether they are Vietnamese or foreign.

In cases of reallocating land or leasing land without auctioning the land use rights or bidding for projects using land, the Border-gate Economic Zone Management Board of An Giang Province decides the rates of land levy, land rent, and the levels of exemption, reduction of land levy, and land rent for each project in accordance with the land price framework issued by the People’s Committee of An Giang Province.

In addition, domestic enterprises of all economic sectors that have investment projects in production and business in the Border-gate Economic Zone of An Giang Province will be considered for loans from state credit funds in accordance with current regulations of the Government of Vietnam on investment and development credit.

More details can be found in Circular 162/2007/TT-BTC, which comes into effect in Vietnam from January 29, 2008.
