On June 27, 2024, the National Assembly passed Law on Traffic Order and Safety 2024.

Regulations on issuing, replacing, reissuing, revoking driver's licenses in Vietnam from January 1, 2025

Article 62 of Law on Traffic Order and Safety 2024 stipulates the issuance, renewal, reissue, and revocation of driver's licenses in Vietnam as follows:

- A driving license is issued to individuals who pass the driving test with satisfactory results.

- Individuals holding a driving license may have their license renewed or reissued in the following cases:

+ The driving license is lost;

+ The driving license is damaged and unusable;

+ Before the expiry date mentioned on the driving license;

+ Change in information recorded on the driving license;

+ A foreign driving license issued by a competent foreign authority that is still valid;

+ A driving license issued by the Ministry of Defense or the Ministry of Public Security when requested or when the license holder no longer undertakes defense or security duties.

- Encouragement to exchange indefinite driver's licenses issued before July 1, 2012, for licenses in accordance with Law on Traffic Order and Safety 2024.

- Not issuing, renewing, or reissuing driver's licenses to individuals violating road Law on Traffic Order and Safetys until they comply with the requirements issued by competent state agencies concerning the resolution of administrative violations in the field of road traffic order and safety.

- A driving license shall be revoked in the following cases:

+ The license holder is found unfit for health according to the medical examination results for each category of driving license;

+ The driving license is issued wrongly according to regulations;

+ The driving license exceeds the temporary retention period or expiration of the statute of limitations for administrative penalty enforcement according to the law on administrative violation handling if the violator does not collect it without a valid reason.

- The Minister of Transport (Hanoi, Vietnam) shall stipulate the conditions, procedures, and processes for issuing, renewing, reissuing, and revoking driver's licenses, except for the case specified in Clause 7, Article 62 of Law on Traffic Order and Safety 2024.

- The Minister of Defense, the Minister of Public Security shall stipulate the issuance, renewal, reissue, and revocation of driver's licenses for military and police forces performing defense and security duties. The Minister of Labor, Invalids, and Social Affairs shall stipulate the conditions, procedures, and processes for issuing, renewing, reissuing, and revoking certificates for operating specialized machinery for individuals holding driver's licenses specified in points d, e, g, h, i, k, l, m, and n Clause 3, Article 89 of Law on Traffic Order and Safety 2024.

More details can be found in the Law on Traffic Order and Safety 2024 which comes into force in Vietnam from January 1, 2025, except for the cases specified in Clause 2, Article 88 of Law on Traffic Order and Safety 2024.

Law on Road Traffic 2008 has been amended and supplemented by the Law amending certain Articles of 37 Laws related to Planning 2018 and the Law on Prevention and Control of Harmful Effects of Alcoholic Beverages 2019 which will cease to be effective from the date Law on Traffic Order and Safety 2024 takes effect in Vietnam, except for the cases specified in Clauses 1, 2, 5, and 6, Article 89 of Law on Traffic Order and Safety 2024.
