Below is the content of the regulations on the issuance, renewal, and reissuance of Special Protection Certificates in Vietnam from January 1, 2025.

On November 12, 2024, the Minister of Public Security of Vietnam issued Circular 70/2024/TT-BCA regulating the forms, management, use, issuance, renewal, re-issuance, revocation, and destruction of Special Protection Certificates.

Regulations on issuance, renewal, and reissuance of Special Protection Certificates in Vietnam from January 1, 2025

Circular 70/2024/TT-BCA applies to the Security Force under the Ministry of Public Security, the Security Force under the Military Security Protection Department, Ministry of Defense, and related agencies, organizations, and individuals involved in security tasks.

In this context, Article 4 of Circular 70/2024/TT-BCA stipulates the issuance, renewal, and re-issuance of Special Protection Certificates in Vietnam  from January 1, 2025, as follows:

(1) Individuals eligible for Special Protection Certificates

- Commander and Deputy Commanders of the Security Force, Public Security Ministry; Director and Deputy Directors of the Military Security Protection Department;

- Leaders of units at department level directly under the Security Force Command according to Circular 20/2020/TT-BCA dated March 3, 2020, by the Ministry of Public Security, which stipulates the functions, tasks, powers, and organizational structure of the Security Force Command, including: Advisory and Operational Department; Protection of Leaders of the Communist Party and the State Department; Protection of Special Important Events and International Guests Department; Protective Technical Department; Central Security Department; Southern Security Department;

- Leaders of security protection units at the department level under the Military Security Protection Department;

- Security officers performing close protection duties;

- Security officers performing specialized protective technical duties.

(2) Cases for issuance, renewal, re-issuance of Special Protection Certificates

- The Special Protection Certificate is issued to individuals specified in (1);

- The Special Protection Certificate is renewed in the case of expiration, damage, or change in personal information of the certificate holder;

- The Special Protection Certificate is re-issued when lost, and is approved by the Commander of the Security Force Command, Director of the Military Security Protection Department as per regulations.

(3) Dossier requesting issuance, renewal, re-issuance of Special Protection Certificates includes:

- A written request and list of cases proposed for issuance, renewal, re-issuance of Special Protection Certificates;

- Photos as regulated in point c, clause 2, Article 3 of Circular 70/2024/TT-BCA;

- In cases where renewal of the Special Protection Certificate is requested, the previously issued certificate must be returned.

(4) Procedure for issuance, renewal, re-issuance of Special Protection Certificates

- The Military Security Protection Department and units at the department level under the Security Force Command prepare the dossier as specified in (3) and send it to the Security Force Command;

- Within 7 working days from the date of receiving a complete and valid dossier, the Security Force Command submits to the Minister of Public Security for consideration and decision on the issuance, renewal, or re-issuance of the Special Protection Certificate.

Regulations on destruction of Special Protection Certificates in Vietnam

- The Special Protection Certificate that is revoked is destroyed, except as provided in clause 3, Article 8 of Circular 70/2024/TT-BCA.

- Procedure for destruction of Special Protection Certificates:

+ The Military Security Protection Department collects Special Protection Certificates subject to destruction along with a written request sent to the Security Force Command;

+ The Security Force Command collects Special Protection Certificates subject to destruction from the Security Force, reports to the Minister of Public Security for decision on destruction;

+ The Commander of the Security Force Command establishes a Destruction Council led by a leader of the Security Force Command as the Chairman, with members representing related units. The method of destruction of Special Protection Certificates is decided by the Chairman of the Council. The destruction must be recorded in a minutes.
