Regulations on Investment in Construction of Headquarters for Agencies of the Communist Party

the Government of Vietnam has just issued Decree 165/2017/ND-CP stipulating the management and use of assets at Communist Party of Vietnam agencies.

The headquarters of the Communist Party's agencies are invested in the following cases:

- The Communist Party's agencies do not have working headquarters or existing headquarters that do not meet legal working conditions, and the State does not have headquarters to allocate and do not fall under cases of renting headquarters;- Reorganizing the system of working headquarters to meet administrative reform requirements.

The working headquarters are invested and constructed according to two models:

- Centralized administrative area;- Independent working headquarters.

The investment in constructing working headquarters is conducted via the following methods:

- Assign organizations with functions to invest in constructing working headquarters according to the centralized administrative area model;- Assign the Communist Party's agencies directly using the working headquarters or organizations with functions to implement the investment construction according to the independent working headquarters model.

The organization assigned to implement the investment construction of working headquarters must have sufficient capability in accordance with construction law and related laws.

Moreover, the construction of working headquarters can also be performed under the public-private partnership investment form and other methods as regulated by law.

In case of investment in constructing working headquarters under the public-private partnership form, the Central Office of the Communist Party, the Provincial Standing Committee, or the agency/unit authorized by the Central Office of the Communist Party, Provincial Committee, Municipal Committee is the authority to sign and execute the project contract.
