Regulations on handling violations for candidates taking the civil servant entrance quality assessment exam in Vietnam (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On November 29, 2023, the Minister of Home Affairs issued Circular 17/2023/TT-BNV on Rules and Regulations on the organization of quality inspection of civil servant input.

Specifically, handling violations for candidates taking the civil servant entrance quality assessment exam will be specified in Article 5 of the Rules and Regulations issued with Circular 17/2023/TT-BNV as follows:

(1) Reprimand

The examiner of the exam room prepares a record, publicly announces it in the exam room and applies it to candidates who commit one of the following errors:

- Intentionally sitting in the wrong place to write down your registration number.

- Communicated with other candidates and was warned, but still committed the offense again.

- Bring into the exam room mobile phones, voice recorders, cameras, computers, technical means of receiving and transmitting information, data backup means, and other information storage and transmission devices.

(2) Warning

The examiner of the exam room prepares a record, announces it publicly in the exam room, and applies it to violators who have been recorded in the form of a reprimand but still intentionally violate the rules and regulations of the exam.
or the candidate commits one of the following errors:

- Exchange assignments or scratch papers with other candidates.

- Using documents, mobile phones, voice recorders, cameras, computers, and other technical means of recording and transmitting information, data backup means, and other information storage devices in the exam room (unless otherwise specified).

(3) Suspension of examination

Candidates are suspended from the exam if the violation has been recorded in the form of a warning but still intentionally violates the rules and regulations of the exam or intentionally causes unsafety and disorder to affect the exam room.

The head of the test site promptly reports to the Chairman of the Accreditation Council to consider and decide to suspend the test for candidates right during the test shift. The suspension of the exam is announced publicly in the exam room.

(4) Deduct test points

(i) Candidates who are reprimanded during the exam will have 25% of the total number of correct answers deducted during the exam.

(ii) Candidates who are warned during the exam will have 50% of the total number of correct answers deducted from the exam.

(iii) When summarizing the results, based on the record of handling violations prepared by the exam room supervisor and the report of the Head of the exam committee, the Secretary of the Accreditation Council reports to the Chairman of the Accreditation Council to consider and decide on subtracting the number of correct sentences for the cases specified in (i), (ii).

(5) Candidates who violate rules and regulations must be recorded, and the exam room supervisor and the violating candidate must both sign the record. After making a record and making it public in the exam room, the exam room proctor must report to the test site head or deputy test site head.

In case the violating candidate does not sign the violation record, the exam room proctor invites two candidates next to him to sign to confirm the incident. In case one of the two candidates or both candidates invited to sign to confirm the incident do not sign the record, the exam room supervisor will still make a record and report to the test site head for consideration and decision.

(6) In the event that the candidate does not sign the exam results sheet before leaving the exam room or discovers that the candidate is signing for another candidate, the test room supervisor must make a record and report it to the test site head or deputy test site head.

(7) Candidates who intentionally cause unsafety and disorder to affect the exam room, in addition to being suspended from the exam, will also be subject to disciplinary action depending on the nature and severity according to the provisions of the law on handling of administrative violations or criminal law.
