According to Article 76 of the Law on Road Traffic Order and Safety 2024, the regulations on handling unexpected situations causing disruption of road traffic order and safety in Vietnam are as follows:
(1) Emergency situations causing disorder and traffic safety on the roads include: traffic congestion; road traffic accidents; damage to road traffic infrastructure; natural disasters, fires, explosions causing loss of road traffic safety; complex situations regarding security and order on the roads.
(2) Agencies, organizations, and individuals who detect situations as specified in (1) must promptly report to the nearest police authority or road management agency; in cases of road traffic accidents, they must report immediately to the agencies and organizations specified in Clause 1, Article 81 of the Law on Road Traffic Order and Safety 2024; if the emergency situation may endanger people and vehicles participating in road traffic, they must take immediate safety warning measures for road users.
(3) The police agencies and road management agencies, upon detecting or receiving information about situations specified in (1), according to their functions and tasks, have the following responsibilities:
- Immediately organize forces to the site where the emergency situation occurred to ensure road traffic order and safety at the location;- Implement the measures specified in Clause 2, Article 74 of the Law on Road Traffic Order and Safety 2024;- Promptly rectify any damage to road traffic infrastructure to restore order and traffic safety;- In case of exceeding capacity, authority, functions, and tasks, promptly notify the competent authorities for resolution;- Implement other measures as prescribed by law.
According to Clause 2, Article 78 of the Law on Road Traffic Order and Safety 2024, measures for resolving traffic congestion in Vietnam are as follows:
- The Traffic Police agency formulates plans for commanding and controlling road traffic; handling violations of laws on road traffic order and safety; and proposing competent authorities to resolve and prevent traffic congestion;- The road management agencies coordinate with relevant agencies, organizations, and individuals to identify the causes of traffic congestion; implement measures according to their authority or propose resolutions to competent authorities;- Relevant agencies, organizations, and individuals are responsible for coordinating with the Traffic Police agency and road management agencies to execute measures to prevent, resolve, and overcome traffic congestion.
(1) Upon receipt of information about damage risks to road traffic infrastructure as prescribed in Clause 1, Article 76 of the Law on Road Traffic Order and Safety 2024 or direct detection of safety threats to road works and irrationalities in traffic organization, the Traffic Police agency has the following responsibilities:
- Handle, rectify within management scope or recommend the road management agency, road manager, and users to handle, rectify promptly;- If necessary, implement commanding and controlling measures for road traffic as prescribed in Article 74 of the Law on Road Traffic Order and Safety 2024 or temporarily suspend traffic activities on the road if safety and traffic order are not ensured.
(2) The road management agency, road manager, and users, within their tasks and authority, have the following responsibilities:
- Receive, inspect, and rectify factors that pose safety risks to road traffic, and notify rectification results to the Traffic Police agency, organizations, and individuals who made recommendations;- Take responsibility if consequences occur due to failure to handle or rectify factors causing road traffic safety hazards as prescribed in point a, Clause 2, Article 79 of the Law on Road Traffic Order and Safety 2024.
