On February 28, 2017, the Minister of Finance issued Circular 16/2017/TT-BTC stipulating the details of certain provisions in Decision 20/2016/QD-TTg regarding financial support for activities combating smuggling, commercial fraud, counterfeit goods and the payment of management, and handling expenses for confiscated assets in accordance with the law concerning the domains of combating smuggling, commercial fraud, and counterfeit goods.
According to the regulations specified in the Circular, the support budget is used for the following expenses:
- Expenses within the regular expenditure estimates but lacking sufficient funds: expenses for propaganda on anti-smuggling and anti-counterfeit activities, purchases of equipment and means for smuggling investigation activities, professional training on anti-smuggling work, fuel expenses, rewards and nighttime work bonuses.
- Special expenses: allowances for officers and soldiers undergoing treatment due to accidents while performing their duties; allowances for those directly involved in investigating, ambushing, and capturing smuggling subjects.
Regulations on receiving voluntary support funds for anti-counterfeit and anti-smuggling activities:
- For voluntary support assets in cash and foreign currency: the anti-smuggling agency will open an account at the State Treasury for management and accounting.
- For voluntary support assets in kind: the anti-smuggling agency will establish state ownership for the assets.
Expenses for buying information in the field of anti-counterfeit smuggling:
According to the provisions of Circular 16/2017/TT-BTC, the advance level for expenses to buy information for anti-smuggling, trade fraud, and counterfeiting activities is determined for each specific case based on the estimated revenue from administrative penalties and the sale of confiscated assets.
Expenses for buying information must have full documentation as stipulated in Circular 16/2017/TT-BTC.
The Circular is effective from April 17, 2017.
