Regulations on Dangerous Locations for Railway Traffic Safety

Decree 65/2018/ND-CP issued by the Government of Vietnam on May 12, 2018, stipulating the detailed implementation of certain provisions of the Railway Law.

Decree 65/2018/ND-CP stipulates details on some issues regarding dangerous locations for railway traffic safety. To be specific, as follows:

Dangerous Locations for Railway Traffic Safety

According to this decree, dangerous locations for railway traffic safety include:

- Locations where railway traffic accidents frequently occur (hereinafter referred to as railway traffic accident black spots);- Locations where railway traffic accidents may potentially occur (hereinafter referred to as potential railway traffic accident spots).- Dangerous level crossings are level crossings where traffic accidents frequently occur or may occur in the area of the level crossing according to the criteria specified by law.

Criteria for Identifying Railway Traffic Accident Black Spots

Railway traffic accident black spots are identified based on the number of accidents and the extent of damage caused by railway traffic accidents that have occurred within 12 months from the last accident in the following cases:

- Locations where at least one very serious traffic accident has occurred.- Locations where at least two serious traffic accidents have occurred.- Locations where at least three minor traffic accidents have occurred.

Criteria for Identifying Potential Railway Traffic Accident Spots

The decree specifies that potential railway traffic accident spots are identified based on the current state of railway infrastructure, railway traffic safety corridors, the number of accidents, and the extent of damage caused by railway traffic accidents that have occurred within 12 months from the last accident, in the following cases:

- At least one accident involving fatalities has occurred, or at least two accidents with injuries have occurred, but not severe enough to be defined as a railway traffic accident black spot.- The current state of the infrastructure, railway traffic safety corridors, and traffic organization have elements that cause railway traffic safety risks, including:- Limited visibility for vehicle operators;- Level crossings that do not meet technical requirements, distance between level crossings not in compliance with the regulations of the Minister of Transport;- Railway traffic safety corridors being violated or crossing densely populated areas;- Areas with many unauthorized crossing points over the railway and other potential danger spots.

Management of Dangerous Locations for Railway Traffic Safety

Depending on each location, different agencies will be responsible for management:

- The Provincial People's Committee where the dangerous railway traffic safety location is located is responsible for:- Leading the organization of monitoring, analyzing, listing, planning for elimination, and implementing measures to ensure railway traffic safety at dangerous railway traffic safety locations on national railways and specialized railways within their management scope;- Organizing the management of the above-mentioned dangerous railway traffic safety locations.- The state management agency specializing in railway transport is responsible for:- Coordinating with the Provincial People's Committee to implement the provisions related to dangerous locations managed by the Provincial People's Committee;- Inspecting and proposing to the Ministry of Transport measures to ensure railway traffic safety at dangerous level crossings on national railways; proposing measures to the Provincial People's Committee to ensure railway traffic safety at the remaining dangerous locations on national railways;- Inspecting and directing national railway infrastructure businesses.- National railway infrastructure businesses are responsible for:- Leading and coordinating with various levels of the Provincial People's Committee to list, plan, and implement safety measures at dangerous railway traffic safety locations on national railways when assigned, leased, or transferred;- Managing records, inspecting, and updating dangerous railway traffic safety locations on national railways to serve management tasks;- Proposing to the state management agency specializing in railway transport measures to ensure railway traffic safety at dangerous locations on national railways.- Owners of specialized railways are responsible for:- Leading and coordinating with various levels of the Provincial People's Committee to list, plan, and implement safety measures at dangerous railway traffic safety locations on specialized railways;- Managing records, inspecting, and updating dangerous railway traffic safety locations on specialized railways to serve management tasks.
