Regulations on Citizens' Status During Health Examination for Military Service

Citizens who are 18 years old are eligible to be conscripted; the conscription age is from 18 years old to the end of 25 years old; up to the end of 27 years old for citizens who have undergone college or university training and have been temporarily deferred from conscription. Thus, in many cases, individuals who are employed but within the conscription age bracket are still subject to medical examinations. Many people have questioned whether they are entitled to receive their salary when they have to take time off work to undergo health examinations.

According to the provisions of the Military Service Law 2015, citizens working at agencies or organizations during the military service registration period, examination, and health check are entitled to full salary, transportation allowances, and existing benefits. Citizens registering for military service, undergoing health examinations, and health checks are guaranteed living and dining policies during the registration, examination, and health check period, along with travel expenses. The policy provisions are applied as stated in Decree 13/2016/ND-CP.

Policy During Military Service Registration Period

Citizens during their initial military service registration, or registering to serve in the reserve, are entitled to the following policy benefits:

For citizens working at agencies or organizations with salaries from the state budget, state enterprises, during the military service registration period, full salary, allowances, and travel expenses are granted according to current legal policies.

For citizens not employed by agencies or organizations with salaries from the state budget, state enterprises, during the military service registration period, the following policies are ensured:

- Meal allowances equivalent to the basic daily meal of non-commissioned officers and infantry soldiers;- Travel expenses covered according to current legal policies.

Policy During Military Health Examination and Check Period

Citizens working at agencies or organizations with salaries from the state budget or state enterprises, who are undergoing health examinations and checks as ordered by the District Military Command Commissioner, are entitled to full salary, existing allowances, and travel expenses according to current legal policies.

Citizens not employed by agencies or organizations with salaries from the state budget or state enterprises, who are undergoing health examinations and checks as ordered by the District Military Command Commissioner, are ensured the following policies:

- Meal allowances equivalent to the basic daily meal of non-commissioned officers and infantry soldiers;- Travel expenses covered according to current legal policies.

Guidance on Implementing Policy Payments During Registration and Health Check Period

Payments are made based on the principle that if the time for travel and military service registration or health examination and check is 4 hours or more in a day, a full day is counted; if it is less than 4 hours, half of the day is counted.

Payment responsibilities are as follows:

- Agencies, organizations, and enterprises are responsible for paying citizens working at agencies or organizations with salaries from the state budget or state enterprises when registering for military service; undergoing health examinations and checks as ordered by the District Military Command Commissioner;- The Commune Military Command is responsible for paying and settling accounts with the District Military Command for citizens not employed by agencies or organizations receiving salaries from the state budget or state enterprises when registering for military service;- The District Military Command is responsible for paying citizens not employed by agencies or organizations receiving salaries from the state budget or state enterprises when undergoing health examinations and checks as ordered by the District Military Command Commissioner.
