On November 28, 2024, Hanoi passed Law on Forces Participating in Protecting Security and Order at the Grassroots level 2023.

Article 14 of Law on Forces Participating in Protecting Security and Order at the Grassroots level 2023 regulates the arrangement of forces to participate in protecting security and order at the Grassroots level as follows:

- Forces participating in protecting security and order at the Grassroots level are consolidated from the civil defense forces, semi-professional commune police, and the Captains and Vice-Captains of civil defense teams, or recruited as per the provisions of the Law on Forces Participating in Protecting Security and Order at the Grassroots level 2023.

- These forces are organized into Security and Order Protection Teams. The jurisdiction of a Security and Order Protection Team covers one or several hamlets or residential groups within a commune-level administrative division, or in districts where no commune-level administration is established.

- Based on the situation, requirements for ensuring security and order, socio-economic conditions, population scale, and natural area of the locality, the Provincial People's Council will define the criteria for establishing Security and Order Protection Teams and the criteria for the number of team members within its management area.

- The Provincial People's Committee decides the number of Security and Order Protection Teams to be established, the number of team members in each hamlet or residential group under its management, down to the commune-level administrative divisions.

- Based on the Decision of the Provincial People's Committee stipulated in clause 4 of Article 14 of the Law on Forces Participating in Protecting Security and Order at the Grassroots level 2023, the Chairman of the Commune-level People's Committee, upon the request of the Commune Police, will decide the establishment of the Security and Order Protection Team and the individual members of the team.

Conditions for Participating in the Forces Protecting Security and Order at the Grassroots level in Vietnam

Article 13 of the Law on Forces Participating in Protecting Security and Order at the Grassroots level 2023 stipulates that Vietnamese citizens who have the desire and meet the following standards and conditions can be considered and selected to participate in the forces protecting security and order at the Grassroots level:

- From the age of 18 to 70; in cases over 70 years old, if they are in good health, the Chairman of the Commune-level People's Committee will consider and decide based on the proposal of the Commune Police;

- Have a clear background; good moral quality; the individual and their family must comply well with the policies and guidelines of the Communist Party, the laws and policies of the State; not currently under criminal investigation, not serving a criminal sentence in the commune, ward, or commune-level town, or not subject to legal or administrative measures. If they have completed a court sentence, they must have had their criminal records cleared; if they have completed an administrative measure, the period for considering them as not having received such measures must have expired according to the law;

- Have graduated or completed at least a primary education program. For border areas, islands, mountainous regions, areas with particularly difficult socio-economic conditions, and ethnic minority areas, it is permissible to select those who have completed primary education;

- Have been permanently or temporarily residing for 01 year or more and living regularly at the place where the application to participate in the forces protecting security and order at the Grassroots level is submitted. For cases stipulated in clause 3 of Article 15 of the Law on Forces Participating in Protecting Security and Order at the Grassroots level 2023, they must be permanently or temporarily residing at the place where the application is submitted;

- Must be in good health as verified by a certificate from a medical facility established and operating in accordance with the law.
