Law on Archives 2024 was approved by the 15th National Assembly of the Socialist Republic of Vietnam, 7th session on June 27, 2024, and takes effect in Vietnam from July 01, 2025.

Regulations on agencies or organizations handing over records and materials to the historical archival unit of the State in Vietnam

According to Article 18 of the Law on Archives 2024, regulations on agencies or organizations handing over records and materials to the historical archival unit of the State in Vietnam are specified as follows:

- agencies or organizations handing over records and materials to the historical archival unit of the State at the central level are regulated as follows:

+ National Assembly, National Election Council, Standing Committee of the National Assembly, Ethnic Council, Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, Secretary General of the National Assembly, Office of the National Assembly.

The Office of the National Assembly serves as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ President, Office of the President.

The Office of the President serves as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ the Government of Vietnam, Prime Minister of Vietnam, Office of the Government of Vietnam.

The Office of the Government of Vietnam serves as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ Supreme People's Court, Supreme People's Procuracy, High People's Court, High People's Procuracy, State Audit Office; Ministry, ministerial-level agencies, agencies under the Government of Vietnam, except as specified in Clause 3, Article 10 of the Law on Archives 2024; agencies and organizations under and directly under the Ministry, ministerial-level agencies performing state management functions in specialized fields;

+ State enterprises established by decision of the Prime Minister of Vietnam, Ministers, Leaders of ministerial-level agencies, agencies under the Government of Vietnam; public service provider established by decision of the Government of Vietnam, Prime Minister of Vietnam, except public service providers under the provincial People's Committee;

+ Central public associations assigned duties by the Communist Party and the State.

- agencies or organizations handing over records and materials to the historical archival unit of the State at the local level are regulated as follows:

+ Provincial People's Councils, Delegations of the National Assembly, Offices of the Delegation of the National Assembly and Provincial People's Councils.

The Office of the Delegation of the National Assembly and Provincial People's Councils serves as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ Provincial People's Committees, Office of the Provincial People's Committee.

The Office of the Provincial People's Committee serves as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ District People's Councils, District People's Committees, Office of the District People's Councils and District People's Committees.

The Office of the District People's Councils and District People's Committees serves as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ Other specialized agencies under the provincial and district-level People's Committees; Provincial and district-level People's Courts, Provincial and district-level People's Procuracies; organizations under specialized agencies of the provincial People's Committee performing state management functions; public service providers under the provincial People's Committee; central agencies, organizations, enterprises organized and operating vertically at the provincial and district levels; state enterprises established by decision of the Chairman of the provincial People's Committee;

+ Commune-level People's Councils, Commune-level People's Committees.

The Commune-level People's Committees serve as the focal point for submitting archival dossiers and documents of the agencies specified in this point;

+ Local public associations assigned duties by the Communist Party and the State.

- In necessary cases, the Prime Minister of Vietnam decides which other state agencies or organizations not specified in Clauses 1 and 2, Article 18 of the Law on Archives 2024 are to submit dossiers and documents to the historical archival unit of the State.

- In cases where agencies or organizations specified in Clauses 1 and 2, Article 18 of the Law on Archives 2024 undergo name changes, they still bear the responsibility of submitting dossiers and documents to the historical archives as stipulated in Article 18 of the Law on Archives 2024.

More details can be found in Law on Archives 2024 which takes effect from July 01, 2025.

Law on Archives 2011 ceases to be effective in Vietnam from the date the Law on Archives 2024 comes into effect, except for the cases specified in points a, b, c, and d, Clause 1, Clauses 5 and 6, Article 65 of the Law on Archives 2024.
