Regulations on adjusting the provincial housing development programs in Vietnam

When there is one of the bases for adjustment, the housing management authority shall adjust the provincial housing development program in accordance with the provisions of Decree 95/2024/ND-CP.

Regulations on adjusting the provincial housing development programs in Vietnam

Housing development involves investment in new construction, reconstruction, or renovation to increase housing space. The basis for building the provincial housing development programs in Vietnam includes:

- National Housing Development Strategy;

- Land use planning, construction planning, urban planning;

- Local socio-economic development conditions; the results of the previous provincial housing development programs; current housing status; housing demand during the period of building the provincial housing development programs.

The order and procedures for adjusting the provincial housing development programs in Vietnam are implemented according to Clause 2, Article 10 of Decree 95/2024/ND-CP as follows:

(1) The adjustment of the provincial housing development programs is carried out when there is a change in one of the following contents due to provincial planning adjustment or approval of provincial planning in a new phase or due to the establishment, dissolution, merger, division, or adjustment of provincial administrative boundaries:

- Proposed land area to develop social housing, resettlement housing, official duty housing, redevelopment, and reconstruction of apartment buildings. Proposed total additional floor area required for housing across the province or centrally governed city during the provincial housing development programs term, in which the housing area demand for each group entitled to social housing support policies and each housing type developed under the project is delineated;

- Determining the overall objectives and specific goals for housing development in the province or centrally governed city;

- Directional targets for housing development within the program term, including average housing area per capita in urban and rural areas and the province or centrally governed city; minimum housing floor area; expected completed and put-into-use housing floor area during the program term; housing quality in urban and rural areas;

- Proposed housing development areas classified by district-level administrative units;

The provincial housing management agency prepares a submission proposing adjustments to the housing development program to the provincial People's Committee for consideration and approval, including detailed outlines, estimated costs for adjusting the housing development program, timelines, and expected units, agencies to build the adjustment program;

(2) The process for adjusting the provincial housing development programs is implemented similarly to the construction and approval of the provincial housing development programs as stipulated in Clause 1, Decree 95/2024/ND-CP;

(3) The maximum time for building and approving the adjustment to the housing development program is 12 months from the establishment of one of the bases stipulated in Clause 1, Article 28 of the Housing Law.

In cases where localities have approved a housing development program but the program does not include targets for housing development for the armed forces or has targets for these groups but the Ministry of National Defense, the Ministry of Public Security of Vietnam proposes to adjust the targets, the provincial People's Committee reports to the same-level People's Council to decide to supplement or adjust these targets in the housing development program; the supplementation or adjustment of these targets is only done once during the approved program term.
