On November 15, 2024, the Minister of Transport of Vietnam issued Circular 37/2024/TT-BGTVT specifying the criteria for monitoring and acceptance of maintenance results for inland waterway transport infrastructure assets based on performance quality.

Regulations on acceptance of maintenance results of inland waterway infrastructure assets in Vietnam based on quality of implementation in 2025​

According to Article 5 of Circular 37/2024/TT-BGTVT, the investor or an agency, organization authorized, or assigned by the investor is responsible for accepting the results of maintenance of inland waterway transport infrastructure assets based on quality performance. In cases where a supervisory consultant is hired, the investor or the authorized organization shall base the acceptance on the supervision results of the supervisory consultant.

- Acceptance of maintenance results for inland waterway transport infrastructure assets based on performance quality is conducted for each task item of the inland waterway route or section as per the signed Contract and recorded as per Form No. 7, Appendix 3 issued together with Circular 37/2024/TT-BGTVT.

- Acceptance of maintenance results is conducted monthly, quarterly, and upon completion as per the agreement in the signed Contract:

+ The acceptance evaluation is conducted through a scoring method with a scale of 100 points (equivalent to 100%) for each task item as stipulated in Appendix 2 issued with Circular 37/2024/TT-BGTVT;

+ Monthly acceptance is conducted based on the periodic supervision results, and any ad-hoc supervision (if necessary);

+ Quarterly acceptance and final acceptance summarize the monthly acceptance results.

Payment for maintenance expenses of inland waterway transport infrastructure assets based on performance quality in Vietnam

- Contractors are paid for the expenses in the payment period corresponding to the achieved acceptance points. Additionally, during the Contract term, the contractor will have reductions in the achieved points for the following cases:

+ A reduction of 25% of the remaining points of the monthly work item upon the second evaluation of below 75% achievement;

+ A reduction of 50% of the remaining points of the monthly work item upon the third evaluation of below 75% or upon the second evaluation of below 50%.

- Consideration for contract termination and prohibition from participating in bidding for management and maintenance of inland waterway transport infrastructure assets in the following year when a work item is evaluated below 75% for the fourth time or below 50% for the third time.

- For on-site deficiencies identified upon acceptance that the contractor has not remedied within the time specified in Appendix 1 issued with Circular 37/2024/TT-BGTVT, the unremedied portion is calculated into the supervision and acceptance results not completed for the adjacent month.

- The contract value of each work item on the inland waterway route or section is evenly divided over the months as the basis for payment and cost deduction.
