Below are the regulations guiding land statistics at the commune level in Vietnam from August 1, 2024, according to Circular 08/2024/TT-BTNMT.

On July 31, 2024, the Minister of Natural Resources and Environment of Vietnam issued Circular 08/2024/TT-BTNMT regulating land statistics, inspection, and the preparation of current land use maps.
According to Article 6 of Circular 08/2024/TT-BTNMT, land statistics at the commune level in Vietnam shall be regulated as follows:
- Preparation work:
+ Collecting dossiers, documents, maps, and data related to land changes in the statistical year at the commune level, administrative boundary dossiers at the commune level; land inventory data from the previous period or land statistics data implemented the previous year at the commune level; receiving the List of cases of land changes during the statistical year and the land inventory period in Appendix IV issued with Circular 08/2024/TT-BTNMT from the district-level land management agency, Land Registration Office;
+ Determining the scope of land statistics at the commune level as prescribed in Article 3 of Circular 08/2024/TT-BTNMT;
+ Classifying, evaluating, and selecting the collected dossiers, documents, maps, and data.
- Reviewing, updating, and correcting land changes within the statistical year:
+ Cases of changes in land type, land user, and managerial entities as listed in the cases of land changes during the statistical year provided by the district-level land management agency, Land Registration Office; updating the information before and after the changes on the land parcels into the List of cases of land changes during the statistical year and the land inventory period in Appendix IV issued with Circular 08/2024/TT-BTNMT;
+ Delineating and editing on the land inventory map and summarizing the parcels according to the regulations specified in Article 20 of Circular 08/2024/TT-BTNMT;
+ Calculating the area in the statistical year by each parcel and updating changed parcels on the land inventory map.
- Processing, aggregating land statistical data at the commune level, and preparing tables as prescribed in points a, b, d, and dd of clause 1 in Article 5 of Circular 08/2024/TT-BTNMT and preparing the List of land parcels for statistical and inventory purposes as specified in Appendix III issued with Circular 08/2024/TT-BTNMT.
- Analyzing and assessing the current land use status and the reasons for land changes within the statistical year compared with the previous year's statistical data and the previous land inventory period, proposing solutions to strengthen land management, and increasing land use efficiency within the commune area.
- Preparing a report on the results of commune-level land statistics with the main content:
+ Overview of natural, socio-economic conditions; organization and implementation status, data sources, documents used to summarize commune-level land statistics, and assessing the reliability of collected documents and data;
+ Evaluating current land use status; analyzing land changes within the statistical year;
+ Specifically assessing cases of changes in administrative boundaries, inconsistencies in administrative boundaries (if any);
+ Proposing, recommending.
- Completing and approving commune-level land statistical results.
- Printing, copying, and delivering land statistical results as prescribed in clause 1 and point a of clause 4 in Article 22 of Circular 08/2024/TT-BTNMT.
- The scope of land statistics and inventory is implemented according to the provisions of clause 1 Article 57 of Land Law 2024 and is determined as follows:
+ The boundaries of administrative units are identified according to the latest administrative boundary dossiers approved by competent authorities;
+ In case of inconsistencies in the boundaries of administrative units at the commune level with the actual management, the related commune-level administrative units jointly identify the inconsistent scope and jointly conduct land statistics and inventory in the inconsistent area according to the indicators specified in Article 4 of Circular 08/2024/TT-BTNMT.
In case the area is not identified in the administrative boundary dossiers, the administrative unit actually managing the area conducts the land statistics and inventory;
+ For administrative units adjacent to the sea, the scope of land statistics and inventory is implemented up to the average lowest tide line over many years; if the average lowest tide line over many years announced by the Ministry of Natural Resources and Environment does not match the actual management and land use status, the land statistics and inventory follow the actual status.
For the sea area as prescribed in clause 4 Article 190 of Circular 08/2024/TT-BTNMT that has not yet been assigned, leased, or simultaneously assigned to the sea area for sea reclamation as prescribed in clause 7 Article 72 of Decree 102/2024/ND-CP, the land statistics and inventory of this area are recorded under unused water surface land.
- The scope of thematic land inventory is implemented according to the provisions of clause 3 Article 57 of Circular 08/2024/TT-BTNMT.
