Regulations for users of industrial explosives in Vietnam

Industrial explosives are explosives used for economic and civil purposes within the list of industrial explosives permitted for production, trade, and use in Vietnam, issued by the Minister of Industry and Trade.

users of industrial explosives must comply with the provisions of Clause 2, Article 38 of the Law on management and use of weapons, explosives and combat gears 2024 as follows:

- Only purchase industrial explosives listed in the permitted industrial explosives list for production, trade, and use in Vietnam from enterprises dealing in industrial explosives;

- Industrial explosives that are not fully utilized or no longer required must be sold back to enterprises dealing in industrial explosives or destroyed according to the regulations of the Minister of Industry and Trade;

- Appoint a blasting commander and fully implement safety standards and technical regulations for the use of industrial explosives during blasting operations;

- Develop a blasting plan suitable to the production scale, natural conditions, and social conditions where blasting takes place. The blasting plan must clearly specify safety measures, protection, and security measures to prevent unauthorized entry into the blasting area; warning, ignition procedures; storage and supervision procedures for the consumption and destruction of industrial explosives at the blasting site and other contents according to standards and technical regulations.

In the case of blasting in residential areas, medical facilities, areas with historical-cultural relics, nature conservation areas, national defense, security works, or other important national works, or other protected areas according to legal regulations, the blasting plan must be approved by the agency issuing the industrial explosives use permit and receive written consent from the provincial People's Committee or the managing agency based on supervision and assessment of blasting effects on the structures and subjects to be protected within the blast impact area;

- Organizations and enterprises granted permits to use industrial explosives by the Ministry of Industry and Trade, and the Ministry of Defense must notify the provincial People's Committee in writing at least 10 days before carrying out activities under the permit.

Conditions for use of industrial explosives in Vietnam

According to Clause 1, Article 38 of the Law on management and use of weapons, explosives and combat gears 2024, users of industrial explosives must ensure the following conditions:

- Established in accordance with the law, registered as an enterprise or registered in the industry, profession, or field requiring the use of industrial explosives;

- Engaged in mineral, petroleum exploration and exploitation; construction works, research, testing; emergency response, disaster recovery activities, or performing tasks assigned by competent authorities requiring the use of industrial explosives as stipulated by law;

- Possess warehouses, technology, equipment, means, and tools serving the activities of using industrial explosives that meet standards and technical regulations; in the absence of warehouses and transportation means, there must be a contract or a document showing the intention to enter into a contract with organizations or enterprises that have suitable warehouses and transportation means to ensure the storage and transport according to this Law;

- Locations using industrial explosives must ensure security, order, fire prevention, and environmental sanitation; ensure a safe distance for construction works and subjects requiring protection according to standards, technical regulations, and related provisions;

- users of industrial explosives must ensure conditions of security and order; the managers, blasting commanders, blasting workers, and persons directly involved in the use of industrial explosives must have appropriate professional qualifications and be trained in industrial explosives safety techniques, fire prevention, and firefighting, and response to incidents in activities involving the use of industrial explosives;

- The scale of explosive use per quarter from 500 kg and above, except for the use of explosives for testing, exploration, geological assessment, and ornamental stone exploitation.
