The content is specified in Circular 09/2016/TT-BTNMT regulating the development and appraisal of weather impact plans issued by the Minister of Natural Resources and Environment.
Regulations for consultation on weather impact plans in Vietnam are as follows:
1. Agencies and organizations specified in Clause 1, Article 3 of Circular 09/2016/TT-BTNMT, during the process of developing a weather impact plan, consultation with the residential community in the area directly affected must be organized according to the provisions of Clause 3, Article 44 of the Law on Hydrometeorology. The implementation process is as follows:
- Agencies and organizations send weather impact plans to the People's Committees of communes, wards, and towns (hereinafter referred to as Commune People's Committees) or the People's Committee of a district, district, town, provincial city, or city under a centrally run city (hereinafter collectively referred to as the district-level People's Committee) according to each case specified in Clause 3, Clause 4, and Clause 5, accompanied by a written request for comments;
- Within a maximum of 20 working days, the Commune-level People's Committee or District-level People's Committee will provide a written response to each content of the weather impact plan from the date of receipt of the document from the agency or organization planning for weather impacts.
2. Collecting community opinions on weather impact plans is conducted in the form of community meetings, including representatives of the commune-level Vietnam Fatherland Front Committee, socio-political organizations, and socio-professional organizations, as well as representatives of some residential groups, villages, and hamlets that are directly affected by the weather impact plan.
3. In case the area is directly affected by the weather impact plan within the commune-level administrative unit, agencies and organizations planning for weather impacts shall coordinate with the Commune-level People's Committee of the directly affected area to organize community meetings.
The commune-level People's Committee invites the members specified in Clause 2 to attend the community meeting.
4. In the event that the area is directly affected by the weather impact plan involving 02 or more commune-level administrative units, agencies and organizations planning for weather impacts shall coordinate with the district-level People's Committee to collect opinions from representatives of the residential community of the commune-level administrative units where the plan is expected to be implemented.
5. In the event that the area is directly affected by a weather impact plan involving 02 or more district-level administrative units, agencies and organizations planning for weather impacts shall coordinate with each district-level People's Committee to collect opinions from representatives of the residential community of the commune-level administrative units where the plan is expected to be implemented.
6. The district-level People's Committee is allowed to collect opinions specified in Clauses 4 and 5 and invite representatives of the components specified in Clause 2 to participate in community meetings through the Commune-level People's Committee of the area directly affected.
7. Agencies and organizations planning for weather impacts are responsible for preparing a report summarizing the opinions of the community.
Opinions of delegates attending the community meeting must be fully and honestly expressed in the meeting minutes, and a report summarizing the community's opinions sent to them is attached to the weather impact plan dossier and requested to be appraised and approved by the competent state agency.
