Regulation on the carrying of gold by individuals who leave or enter Vietnam with passports

This is a notable content of Circular No. 11/2014/TT-NHNN of the State Bank of Vietnam on the carrying out of gold by individuals on exit or entry, effective from May 15, 2014.

According to Article 2 of Circular No. 11/2014/TT-NHNN of the State Bank of Vietnam, the carrying of gold by individuals who leave or enter Vietnam with passports is prescribed as follows:

- Vietnamese and foreign individuals who leave or enter Vietnam with passports may not carry ingot gold and material gold. Foreign individuals who carry ingot gold and material gold when entering Vietnam with passports shall carry out the procedures for depositing the gold amount at the customs warehouse in order to bring it out of the country when being on exit or carry out procedures for bringing such amount abroad and shall bear all related expenses.

- Vietnamese and foreign individuals who carry jewelry gold and fine-art gold articles in a total amount of 300 (three hundred) grams or more when leaving or entering Vietnam with passports shall declare such with customs offices.

Moreover, according to Article 3 of Circular No. 11/2014/TT-NHNN, the carrying of gold by individuals who leave or enter Vietnam with border laissez-passers, entry or exit laissez-passers or border identity cards is prescribed as follows:

- Vietnamese and foreign individuals who leave or enter Vietnam with border laissez- passers, entry or exit laissez-passers or border identity cards may not carry raw material gold, ingot gold, jewelry gold and fine-art gold articles, except the cases specified in Clause 2 of this Article.

- Vietnamese and foreign individuals who enter or leave Vietnam with border laissez- passers, entry or exit laissez-passers or border identity cards may wear jewelry gold for ornamental purposes, including rings, necklaces, strings, ear-rings, needles and other jewelry articles. If the carrying of gold is in a total amount of 300 (three hundred) grams or more, they shall declare such with customs offices.

Besides, according to Article 4 of Circular No. 11/2014/TT-NHNN, the carrying of gold by individuals leaving or entering Vietnam for permanent residence is as follows:

- If foreign individuals, who are permitted to permanently reside in Vietnam, carry along material gold, ingot gold, jewelry gold and fine-art gold articles in a total amount of 300 (three hundred) grams or more, they shall declare such with customs offices.

- Vietnamese individuals, who are permitted to permanently reside abroad, may carry along material gold, ingot gold, jewelry gold and fine-art gold articles in accordance with the following provisions: Those who carry gold in a total amount of between 300 (three hundred) grams and under 1 (one) kilogram shall declare such with customs offices; Those who carry gold in a total amount of 1 (one) kilogram or more must have permits for carrying of gold out of the country for permanent residence abroad granted by State Bank branches of provinces or centrally run cities where they reside, and at the same time shall declare such with customs offices.
