The following article contains information on the payment for the solid waste collection services at source in Ho Chi Minh City, Vietnam, as stipulated in Decision 63/2024/QD-UBND.

On September 20, 2024, the People's Committee of Ho Chi Minh City, Vietnam issued Decision 63/2024/QD-UBND on Regulations for domestic solid waste management in of Ho Chi Minh City, Vietnam.

1. Regulation on payment for the domestic solid waste collection services at source in Ho Chi Minh City, Vietnam, Vietnam

According to the provisions of Clause 10, Article 6 of the Regulation issued together with Decision 63/2024/QD-UBND, the inspection, supervision, sanctioning, acceptance, and payment for the provision of domestic solid waste collection services at source in Ho Chi Minh City, Vietnam are implemented as follows:

- Individuals, households, and waste source owners, based on the service provision contract of collection at source, evaluate the service provision of the domestic solid waste collector and pay the service provision fee for collection at source according to the service price agreed upon in the contract.

In cases where the service provision process of the domestic solid waste collector at the source does not comply with the agreed time, frequency, or sanitation quality as agreed in the contract, individuals, households (and small waste source owners choosing the management form of domestic solid waste like individuals, households) reflect this to the head of the neighborhood or hamlet, who then reports to the commune-level People's Committee to promptly remind the domestic solid waste collector (in writing or meeting minutes) to rectify this work and handle contract violations.

In cases where more than 20% of individuals, households (and small waste source owners choosing the management form of domestic solid waste like individuals, households) in the same collection route reflect that the domestic solid waste collector violates the service provision contract, and the commune-level People's Committee has reminded the domestic solid waste collector more than once a month (in writing or meeting minutes), the commune-level People's Committee organizes to gather opinions on changing the domestic solid waste collector from the collective of individuals, households (and small waste source owners choosing the management form of domestic solid waste like individuals, households) in the same collection route that the domestic solid waste collector is providing services.

The chosen solution will follow the opinions of the majority of individuals, households (and small waste source owners choosing the management form of domestic solid waste like individuals, households) in the same collection route and the commune-level People's Committee will report to the district-level People's Committee for direction.

- Individuals, households, waste source owners, and domestic solid waste collectors who violate issues related to the Regulation issued together with Decision 63/2024/QD-UBND and other related regulations will be sanctioned according to current applicable regulations.

2. Conditions for Participation in domestic solid waste Collection Activities at Source in Ho Chi Minh City, Vietnam

Conditions for participation in domestic solid waste collection activities at source in Ho Chi Minh City, Vietnam are specified in Clause 2, Article 6 of the Regulation issued together with Decision 63/2024/QD-UBND which include:

- Ensuring legal entity status according to regulations, following the transformation roadmap of the independent garbage collection force into cooperatives/enterprises/organizations with legal entity status of the People's Committee of the City;

- Ensuring sufficient requirements for manpower, vehicles, and special equipment to collect all domestic solid waste of individuals, households, and waste source owners who have signed contracts and transport to the gathering points, transfer stations according to regulations;

- Using vehicles and equipment for domestic solid waste collection at the source that meet technical requirements according to current regulations.

More details can be found in Decision 63/2024/QD-UBND which comes into force in Vietnam from October 1, 2024.
