Regular Inspections of Juvenile Offenders Subject to Educational Measures Required

This is an important content of Decree 10/2012/ND-CP detailing the implementation of judicial educational measures at communes, wards, and commune-level towns for juvenile offenders, issued on February 17, 2012.

To be specific, in Article 20 of Decree No. 10/2012/ND-CP, the responsibilities of agencies, organizations, and schools assigned to supervise and educate minors who commit crimes and are subject to educational measures at commune-level towns are specified as follows:

- Assign individuals from their agencies, organizations, or individuals who meet the conditions and capabilities stipulated in Clause 1, Article 8 of Decree No. 10/2012/ND-CP to directly perform supervision, education, and assistance tasks for the educated individuals.- Lead the implementation or recommend to the commune-level People’s Committee, agencies, and organizations suitable forms of support and assistance for the educated individuals in study, job search, loan for production, business, and life stabilization.- Regularly check, follow up, and communicate with the person assigned to supervise, educate, and the family of the educated individual to grasp their situation and progress.- Timely support and motivate the educated individuals to resolve difficulties and obstacles in complying with educational measures and in life.- Closely coordinate with the commune-level People’s Committee, police, schools, social organizations, mass organizations, residential units, and families to organize cultural and sports activities, movements to protect security, social order, social safety, prevent social evils, and other healthy recreational activities to help the educated individuals become useful to society.- Report and propose for the educated individuals to be transferred to another place of residence according to the regulations in Article 11 of Decree No. 10/2012/ND-CP and the law on residence.- Consider and recommend that the commune-level People’s Committee and the district-level criminal enforcement agency of the police propose the competent Court to terminate the period of compliance with educational measures at commune-level towns for the educated individuals according to the regulations in Article 12 of Decree No. 10/2012/ND-CP.- Periodically report or when requested to, report to the commune-level People’s Committee on the situation and results of supervising, educating, and the study, and self-improvement of the educated individuals.- Manage, utilize, collect documents, supplement execution profiles, and monitor the progress of the educated individuals according to the regulations in Article 7 of Decree No. 10/2012/ND-CP.
