Recently, the Government of Vietnam issued Decree 94/2009/ND-CP to provide guidance on the amended Law on Drug Prevention and Control concerning post-rehabilitation management in Vietnam.
Reduction, suspension, or exemption of post-rehabilitation management period in Vietnam (Illustration)
Article 14 of Decree 94/2009/ND-CP stipulates the reduction, suspension, or exemption of the post-rehabilitation management period at the place of residence. Specifically as follows:
- A person post-rehabilitation who has served two-thirds of the period under the post-rehabilitation management decision, if they make commendable achievements or show significant progress, the Chairman of the Commune People's Committee shall propose to the Chairman of the District People's Committee to decide on reducing part or exempting the remaining period.
- In case a person under the post-rehabilitation management decision is seriously ill, they shall be temporarily suspended from executing the decision for treatment; the treatment period is not counted in the execution period of the decision.
- For pregnant women, the execution of the decision shall be temporarily suspended until the child is thirty-six months old. If during the suspension period, the person makes significant progress or commendable achievements confirmed by the Commune People's Committee at the place of residence, they shall be exempted from the remaining execution period.
- For persons with terminal illnesses certified by a district-level or higher hospital, they shall be exempted from the remaining execution period.
- The sequence and procedures for considering the reduction, suspension or exemption of the post-rehabilitation management decision at the place of residence are as follows:
- The Chairman of the Commune People's Committee shall make a list of cases for reduction, suspension, or exemption from the post-rehabilitation management decision stipulated in Clauses 1 and 2 of this Article and send a document to the Head of the District Labor - War Invalids and Social Affairs Office.- Within three days from the date of receipt of the document from the Chairman of the Commune People's Committee, the Head of the District Labor - War Invalids and Social Affairs Office must verify and send a document to the Chairman of the District People's Committee.- Within two days from the date of receipt of the document from the Head of the District Labor - War Invalids and Social Affairs Office, the Chairman of the District People's Committee must consider and decide on the reduction, suspension, or exemption of the post-rehabilitation management decision.
