Regarding this issue, LawNet would like to answer as follows:

On November 30, 2023, the Minister of National Defense issued Circular 99/2023/TT-BQP regulating technical safety inspection and environmental protection of motor vehicles in the Ministry of National Defense.

1. What is the inspection of the technical safety and environmental protection of motor vehicles?

Inspection of the technical safety and environmental protection of motor vehicles is the initial and periodic inspection and assessment of the technical safety and environmental protection status of motor vehicles according to standards, regulations, and policies of the State and the Ministry of National Defense.

2. Records of inspection of technical safety and environmental protection of motor vehicles in the Ministry of National Defense from January 15, 2024 in Vietnam

2.1. First inspection records

Specifically, Article 6 of Circular 99/2023/TT-BQP regulates the first inspection documents for motor vehicles in the Ministry of National Defense as follows:

(1) Military motor vehicles

- Official dispatch or introduction requesting inspection signed and stamped by the commander of an agency or unit at regimental level or equivalent or higher according to regulations;

- Vehicle registration certificate; vehicle record (only applicable to registered military motor vehicles);

- Temporary license plate (only applicable to military motor vehicles that have not completed registration procedures);

- Certificate of technical safety quality for renovated military motor vehicles (only applicable to renovated military motor vehicles).

(2) Enterprise motor vehicles

- Official dispatch or Letter of Introduction requesting inspection signed and stamped by the director or deputy director of the enterprise according to regulations;

- Vehicle registration certificate;

- Copy of Certificate of technical safety and environmental protection quality for motor vehicles (only applicable to imported motor vehicles);

- Copy of factory quality inspection card (only applicable to domestically produced and assembled motor vehicles);

- Copy of Certificate of technical safety and environmental protection quality for renovated motor vehicles (only applicable to renovated motor vehicles).

2.2. Periodic inspection records

Periodic inspection records for motor vehicles of the Ministry of National Defense will be carried out as follows:

(1) Military motor vehicles: Follow the regulations in Points a and b, Clause 1, Article 6 of Circular 99/2023/TT-BQP.

(2) Enterprise motor vehicles: Follow the regulations in Points a and b, Clause 2, Article 6 of Circular 99/2023/TT-BQP.

(3) Prepare inspection documents

- The inspection facility receives documents and checks documents according to the provisions of Clauses 1 and 2, Article 6 and (1), (2); If not complete, instruct agencies, units, and enterprises to supplement and complete;

- Inspection facilities print the technical specifications of motor vehicles from the capacity management database of the Department of Vehicles and Machinery; inspect motor vehicles, and compare them with the paperwork and printed technical specifications. In case the motor vehicle technical specifications are not in the database, the inspection facility must prepare a motor vehicle record sheet according to Form No. 01 Appendix IV issued with Circular 99/2023/TT-BQP in the accreditation management program;

- If the inspection and comparison results meet the requirements, enter the technical specifications and administrative information of the motor vehicle into the inspection management program and record the vehicle's inspection record; print a motor vehicle record sheet (only applicable to motor vehicles inspected for the first time or not yet in the database);

- Taking 02 clear overall photos of the motor vehicle's license plate to save (a photo at a diagonal angle of about 45 degrees from the front side of the vehicle and a photo from the back at the opposite corner, showing the time taken on the photo).

Circular 99/2023/TT-BQP takes effect on January 15, 2024, replacing Circular 34/2010/TT-BQP.
