Recommendation for employees to take a break of at least 10 minutes after every 90 minutes of overtime in Vietnam

Vietnam's General Confederation of Labor issued Dispatch 4359/TLD-QHLD dated June 16, 2022 on implementation instructions Resolution 17/2022/UBTVQH15. In particular, it is suggested that enterprises give employees at least 10 minutes of break after every 90 minutes of overtime.

Specifically, the General Confederation of Labor of Vietnam guides and orients trade unions at all levels (especially grassroots trade unions) on certain aspects of dialogue and negotiation with employers when organizing overtime. For example:

- The grassroots trade union in Vietnam should negotiate with the employer on an overtime wage that is higher than the minimum or higher than what the enterprise is paying to motivate, encourage, and better ensure the interests of employees.

- If the overtime in a shift is more than 3 hours, in addition to the regulation on the break between shifts, it is suggested that the employer should arrange a break of at least 10 minutes every 90 minutes of working overtime for employees working in continuous production lines.

- Proposing additional meals and snacks for employees after finishing overtime to recover their health.

- Proposing enterprises to support child care for employees, especially those with children under 6 years old.

- Strengthening the ventilation and lighting systems according to the standards (reducing the temperature of the production area in the summer by increasing the cooling fans; increasing the ventilation level in the factory; ensuring the illuminance and glare of the factory). lighting system in accordance with standards and technical regulations...

In addition to the above, depending on the actual situation and opinions and recommendations of union members and employees, the grassroots trade union organizes dialogues and negotiations with the employer to promptly resolve the issues. arising from the adjustment of overtime hours, contributing to ensuring the legitimate rights and interests of employees and stabilizing security and politics in the locality in Vietnam.
