I am Nguyen Thi Thuy Nga. My family has recently moved to a different province. During the moving process, I inadvertently lost my Marriage Registration Certificate. Could you please inform me whether I can get a replacement in my case and what the procedure would be?
Secretary of Law would like to answer your inquiry as follows:
According to the regulations at Article 24 of Decree 123/2015/ND-CP:
"Birth registration, marriage registration, and death registration which were registered at a competent Vietnamese authority before January 1, 2016, but the civil status books and original civil status documents are both lost, may be re-registered."
The procedures for re-registration of marriage are carried out through the following steps (based on the provisions in Article 27 of Decree 123/2015/ND-CP):
Step 1: Prepare the re-registration dossier for marriage including the following documents:
- Declaration form according to the prescribed template;- A copy of the previously issued Marriage Certificate. If unavailable, a copy of the file or personal documents that contain information related to the marriage registration can be submitted.
Step 2: Submit the dossier to the People’s Committee at the commune level.
Within 05 working days from the date of receipt of the dossier, civil status - judicial official shall check and verify the dossier.
- If the dossier for re-registration of marriage is complete, accurate, and in conformity with the law, the civil status - judicial official shall re-register the marriage following the new registration procedure.- If the re-registration of marriage is undertaken at the People’s Committee of the commune that is not the original place of registration, the civil status - judicial official shall report to the Chairman of the People’s Committee with a written request to the People’s Committee of the original registration place for checking and verifying the retention of the civil status book at the locality.
Within 05 working days from the date of receipt of the written request, the People’s Committee of the original registration place shall check, verify, and respond in writing regarding the maintenance status of the civil status book.
Within 03 working days from the date of receipt of the verification result indicating that the civil status book is no longer maintained at the original registration place, if the dossier is complete, accurate, and in conformity with the law, the civil status - judicial official shall proceed with the re-registration of the marriage according to new registration procedures.
The marital relationship is recognized from the date of the previous marriage registration and is clearly stated in the Marriage Certificate and Civil Status Book. If the exact date and month of the previous marriage registration cannot be determined, the marital relationship is recognized from January 1 of the year of the previous marriage registration.
Thus, according to the above regulations, you have the right to re-register your Marriage Certificate following the procedures specified above.
