This is an important content in Decree 17/2014/ND-CP stipulating the organization and operation of the Diplomatic Inspectorate.
According to Decree 17/2014/ND-CP, the Chief Inspector of the Ministry decides to re-inspect the case that has been concluded by the Chairman of the Provincial People's Committee, the city under Central authority, Chairman of the State Committee for Overseas Vietnamese under the scope and state management authority of the Ministry of Foreign Affairs but shows signs of legal violations as assigned by the Minister of Foreign Affairs.
To be specific, the contents related to the re-inspection process are regulated as follows:
- The re-inspection decision includes the contents stipulated in Article 44, Article 52 of the Law on Inspection. No later than 05 working days from the date of signing the re-inspection decision, the person who issued the re-inspection decision must send the re-inspection decision to the person who signed the inspection conclusion and the re-inspection subject.- Based on the re-inspection decision, the re-inspection time limit, the re-inspection duration, the tasks, and the powers of the person who issued the re-inspection decision, the Head of the Inspection Team, and the members of the Inspection Team to report the re-inspection results as per the regulations of the Law on Inspection, Decree 86/2010/ND-CP, Decree 07/2012/ND-CP.- The person who issued the re-inspection decision makes a re-inspection conclusion. The content of the re-inspection conclusion must comply with the regulations of the Law on Inspection.- The re-inspection conclusion is sent to the Minister of Foreign Affairs and the Chief Inspector of the Government of Vietnam for reporting.
